Abstract

South Africa’s agricultural sector has undergone substantial policy reform since the dawn of democracy in 1994. Now, twenty years later, it is an opportune time to look back at this period to review key successes and failures. This article revisits South Africa’s context and policy at the start of this period, the reforms that followed, and evaluates the transformational effect (or lack thereof) on the sector. For this purpose, the article pulls from both qualitative sources and descriptive statistics to provide both a historical context and current perspective. The United States Supreme Court in National Federation of Independent Business v. Sebelius (Sebelius), famously invoked broccoli to limit the scope of Commerce Clause. All of the Justices used broccoli as a plot device to further their respective arguments answering whether the individual mandate to buy health insurance was constitutional. This article discusses the other end of the economic spectrum – local. We explicate Florida’s local government regulations of urban planting, growing, and selling of broccoli, as well as other fruits, vegetables, and animals. Modern breeding, based upon molecular biology using genetic information, has made rapid advances. Breeders using rDNA techniques properly can think of this technique as traditional biotechnology. Within the past ten years, breeders have begun to use newer techniques [site-directed nuclease techniques (SDNs), RNAi, and synthetic biology] to create and to develop plants and animals with desired genetic traits. The subject engenders heated debate whenever it surfaces, most recently in September 2005 when Senator Daniel Akaka (D-HI) proposed an amendment to the FY 2006 agriculture funding bill to withhold federal monies to research institutions that purchase animals from Class B dealers.

An increase in marine mammal stranding and die-off events has been observed along the California coast. The exact cause to explain for these recent events is unknown, but El Niño and harmful algal blooms are established sources for temporary decreases in marine mammal health. To determine whether El Niño could be causing and amplifying harmful algal blooms, particularly in Monterey Bay where they occur frequently, data was analyzed from the Marine Mammal Center in Sausalito, California. Sixty-nine percent of adults in the United States, sixty-four percent in the United Kingdom, and over one-third worldwide are overweight or obese. These staggering figures continue to grow, with accompanying emotional, physical, and economic consequences, both for individuals and society as a whole. The role law plays in facilitating this global trend is significant, and yet puzzlingly, little recognized or understood. The current food system is profoundly structurally flawed: it establishes unhealthy dietary behaviors as the default option for consumers.
