West Virginia Law Review

The West Virginia Supreme Court of Appeals, since it achieved its present composition by virtue of the November, 1976, general election, has had a dramatic impact on the development of workmen's compensation law in West Virginia. Although it is difficult to single out the most significant decisions of the court in this area, most practitioners would probably agree that the two cases having the greatest impact upon workmen's compensation practice and related matters are Mandolidis v. Elkins Industries, Inc. and Mitchell v. State Workmen's Compensation Commissioner. The Mandolidis decision received extensive treatment in an earlier article in this law review …

For the last sixty years, workers' compensation has constituted a distinct subject of administration in Georgia municipal government and, consequently, a distinct subject of controversy in Georgia municipal law. Of course, many of the problems, issues, and solutions ar ethe same, whether the covered employment be municipal or private in nature. Still, municipal law possesses its own quagmires, quandaries, and conundrums; some of those peculiarities can yield unique questions regarding workers' compensation. Recovery For Accidental Injuries Under The Virginia Workmen's Compensation Act, Douglas E. Ray, R. Craig Evans, Jay H. Steele

University of Richmond Law Review

The Virginia Workmen's Compensation Act, first enacted in 1918, generally provides for case benefits and medical care to individuals injured in employment-related accidents. While the Act is neither tort law nor social insurance, it contains elements of both. As social legislation, the Act plays an important role in protecting citizens from loss of wages and provides an important supplement to protection available from the federal Old Age, Survivors' Disability and Health Insurance Program, unemployment compensation and private health and accident insurance plans. In 1979, more than 43,000 Virginia employees filed claims under the Act. Unlike other social insurance programs, however, …

Workers' Compensation—Third-Party Tort Liability To Injured Workers Under R.C.W. Title 51—Seattle-First National Bank V. Shoreline Concrete Co., 91 Wn. 2d 230, 588 P.2d 1308 (1978), Cheryl A. Johnson

Washington Law Review

Washington's Industrial Insurance Act immunizes employers from tort actions brought by their injured employees. Dissatisfied with the modest compensation assured by the Act, employees often seek other parties to sue. Manufacturers who supply job-related equipment to employers are popular defendants because they are unprotected by the Act. In Seattle-First National Bank v. Shoreline Concrete Co. the Washington Supreme Court rendered the manufacturer's role as the employer's cotortfeasor particularly onerous. With only a cursory examination of policy, the court interpreted the Act as immunizing employers from suits by manufacturers for contribution, indemnity, or apportionment. The November elections of 1976 brought about a major change in the composition of the West Virginia Supreme Court of Appeals. Three new justices, a majority of the court, were elected. The consequences of the election have been widely felt throughout the State. In no area has its impact been greater, however, than in the area of workmen's compensation law. The court has shown a great willingness to hear workmen's compensation appeals. On February 15, 1978, Congress enacted the Black Lung Benefits Reform Act of 1977. The passage of this legislation followed months of congressional indecision over just how the existing black lung benefits system could be reformed. During this period, the financing of the program appeared to be the most divisive issue. That issue was finally resolved by the enactment in late January of the Black Lung Benefits Revenue Act of 1977. The Effect Of The Pendency Of Claims For Compensation Upon Behavior Indicative Of Pain, Cornelius J. Peck, Wilbert E. Fordyce, Richard G. Black

Recent theories endeavoring to explain manifestations of pain in humans have increasingly recognized the effect of sociological and psychological processes on pain.This article reports findings made in a research project based on the hypothesis that the pendency of a claim for compensation has the effect of causing greater, more intense, and more persistent pain than would otherwise be experienced if persons had not sought compensation. The study assumed that pain can most accurately be measured by observing behavior indicative of pain and focused on data reflecting such behavior.
