This article analyzes the extent to which the riparian doctrine can be employed to protect minimum streamflows for purposes of maintaining fish and wildlife habitat, recreational use capacity and waste assimilative capacity of watercourses in the eastern states.

Section 11 of the March 17, 1980 Agreement between the United States Government by the Secretary of the Interior and the Middle Rio Grande Conservancy District (MRGCD), provides for a quantity of water to be stored in the El Vado Reservoir in order to ensure the prior and paramount water rights of 8.847 acres of land as designated of the Six Middle Rio Grande Pueblos (SMRGP) of Cochiti, Santo Domingo, San Felipe, Santa Ana, Sandia, and Isleta.

In 1974 the Crow Tribal Council enacted a resolution restricting reservation hunting and fishing to tribal members. No distinction was made between lands owned by the tribe or its members and the nearly thirty percent of the reservation area held in fee simple by non-members and the State of Montana. The resolution also purported to govern the Big Horn River, the bed of which the tribe claimed under its 1868 treaty with the United States. The State of Montana refused to recognize the tribe's jurisdiction to enact and enforce this restriction and continued to license non-member hunting and fishing within …
