This Note outlines the public trust remedies presently in place in California by discussing the background of the public trust doctrine and the appropriative water rights system in California as well as the holdings of the Mono Lake court. This Note also proposes changes to improve both the administrative and judicial public trust remedies.

Competition for scarce water resources has been the predominant concern in Washington water law, but this Comment focuses on the opposite problem—the disposal of unwanted water. Water drainage has great significance as a problem which permeates land development. Almost any development of land is likely to alter the flow of water draining from the land to the possible harm of neighboring property. While many aspects of drainage are now regulated through institutional bodies created by the state legislature and municipalities, this Comment addresses the problems that arise between neighboring landowners when one alters the drainage of water to the consequent …

Federal Supervision Of State Water Quality Standards Under The Clean Water Act, Jeffrey M. Gaba
Vanderbilt Law Review
Renewed interest in an expanded role for water quality standards in the regulatory scheme has developed recently. This inter-est is due in part to the perception that the use of water quality standards is a particularly "cost-effective" approach to pollution control. At least in theory, water quality standards are set no higher than necessary to achieve the desired environmental goal.Further, as more and more industrial facilities achieve compliance with technology based requirements, attention has begun to focus on additional techniques including water quality standards, for imposing more stringent limitations." Expanding municipal and Industrial demand, along with increasing use of supplemental irrigation have escalated consumptive water use dramatically In the Eastern United States since World War II. This escalated use already has caused water shortages in some parts of the East, and experts predict more widespread water supply problems In the future.
As the inadequacies of the common law water rights system in a water-scarce environment have become evident, many eastern states have supplemented or replaced common law rules with some form of statutory water allocation system.
