A prolonged drought in California has prompted renewed interest in proposals to transfer water from the Pacific Northwest, where rainfall is more plentiful, to the arid Southwest. While recent storms have obviated the need for water transfers at the present time, it is likely these proposals will resurface with the next drought. This Comment will examine past proposals, and discuss less expensive and less drastic means for satisfying the need for water in the Southwest.

Cause For Cautious Celebration: Hungarian Post-Communist Environmental Reform, Karen S. Libertiny

In October 1989, the Hungarian Communist regime collapsed and was replaced by a democratic government. This new government was confronted with a visible and grave concern: environmental degradation. In just three years, the new Hungarian government, sometimes of its own impetus, sometimes at the prodding of environmentalists and foreign governments, has taken tremendous steps toward establishing palpable environmental legislation. More importantly, it has created an administrative and information-gathering infrastructure capable of sustaining a cohesive system of environmental protection initiatives. In Lucas v. South Carolina Coastal Council, the United Supreme Court was forced once again to delve into the law of regulatory takings. This experience is seldom a pleasant one. Echoing the poet John Milton, an exasperated state court judge once described takings law as a “Serbonian Bog.” Unfortunately, the takings doctrine is only slightly more comprehensible after the Lucas decision than it was before. Nevertheless, progress in this area, however modest, deserves praise, and the Court is to be commended for clarifying one aspect of takings jurisprudence. When the United States ratified the 1967 U.N. Protocol Relating to the Status of Refugees (Protocol), it undertook not to "expel or return (refouler) a refugee in any manner whatsoever to the frontiers of territories where his life or freedom would be threatened" on specified grounds. On May 24, 1992, President Bush issued an executive order, known as the Kennebunkport Order, authorizing the United States Coast Guard to interdict vessels on the high seas suspected of containing Haitians destined for U.S. shores and to return such persons to Haiti without regard to whether their lives or freedom would …

Groundwater Law In The Great Lakes States: A Lawyer's Catalog For The Benefit Of Water Planners, Robert H. Abrams

Water rights are of single importance in the Great Lakes region. Of primary concern are the various laws that govern the allocation and use of water. Virtually every Great Lakes state has its own rich history of judicially resolved water disputes. These disputes have occasioned the generation of a common law of waters and water rights which are often supplemented by statutes. Not only is this true for surface waters, it is also true for groundwater. It is the groundwater resource that this article addresses.
