The Unsettling Of The West: How Indians Got The Best Water Rights, David H. Getches

A single, century-old court decision affects the water rights of nearly everyone in the West. The Supreme Court's two-page opinion in Winters v. United States sent out shock waves that reverberate today. By formulating the doctrine of reserved water rights, the Court put Indian tribes first in line for water in an arid region. Priority is everything where water law typically dictates that the senior water rights holder is satisfied first, even if it means taking all the water and leaving none for anyone else. In the West, water rights belong to "prior appropriators." The earliest users of water secure …

Except for limited provisions, Florida law does not establish a formal link between land planning and water planning. In light of the importance of water resources for the future development of the State, this is a significant "missing link."

This article explores the link between water management and land use planning. First, in Section II, this article provides an overview of water management in Florida. Then, in Section III, this article analyzes the differences between planning and regulatory permitting and asserts that both are needed for effective protection of water resources. The Necessity Of Preventing Unilateral Responses To Water Scarcity-The Next Major Threat Against Mankind This Century, Leticia M. Diaz, Barry Hart Dubner

Cardozo Journal of International and Comparative Law

The article examines the legal and environmental challenges surrounding water scarcity, using the Great Lakes as a case study. It explores the tension between equitable resource utilization and sustainable development under international and regional legal frameworks. The analysis highlights the role of the International Joint Commission (IJC) in managing shared water resources and emphasizes the need for balanced approaches to address competing economic, environmental, and intergenerational concerns. The Great Lakes serve as a critical example of the complexities of managing a finite, shared resource.

The Marine Industry Master Plan was prepared by the Marine Industries Association of South Florida (MIASF) to present a comprehensive and coordinated action agenda for retaining and expanding the marine industry in Broward County. This Master Plan is an extension of a strategic planning process conducted by the MIASF in which the major issues confronting the industry were identified along with an initial strategy to address those issues. Part II addresses the historical and conceptual foundations of the general intent standard, also outside and within the environmental law context. For more than one hundred years, railroad cars rumbled and roared along tracks in the Coeur d'Alene River Basin, serving the mining industry in the Panhandle of northern Idaho. As in many parts of the American West, the history of railroads in northern Idaho largely reflects the history of mining in the region. The first gold was discovered in this area in 1883, the same year that the area saw its first line of the Northern Pacific Railroad. In 1885, the Bunker Hill mine was established near the present town of Kellogg. Four years later, the first rail line of …

International Water Law For The 21st Century: The Contribution Of The U.N. Convention, Stephen C. Mccaffrey

In May, 1997, the United Nations General Assembly adopted the Convention on the Law of the Non- Navigational Uses of International Watercourses, a treaty that largely codifies the general principles of international water law. While not entirely free from controversy, the Convention has already been influential and will doubtless continue to be well into the 21st century. This paper provides an overview of the Convention, comments on some of its salient provisions, and considers its future influence.
