State V. Colosimo: Minnesota Anglers’ Freedom From Unreasonable Searches And Seizures Becomes “The One That Got Away”, Edwin J. Butterfoss, Joseph L. Daly

William Mitchell Law Review

This article examines the various opinions in the Colosimo case, including the opinion of the Minnesota Court of Appeals (which was reversed by the supreme court), as well as the majority, concurring, and dissenting opinions of the supreme court. The article provides a brief background of how the issue of stops and inspections by conservation officers has been dealt with in other jurisdictions before turning to a critique of the Minnesota Supreme Court's decision in Colosimo, which the authors consider far too expansive. The decision in Colosimo undermines the right of citizens of Minnesota to be free from invasions of …

Faculty Scholarship

EPA vs. Clean Water presents case studies of the ostensible failure of the United States Environmental Protection Agency (EPA) to implement the Clean Water Act in three principal areas: water quality impacts from dam operations, state water quality certification for nonpoint source discharges, and antidegradation requirements for nonpoint sources.

Water Follies: Groundwater Pumping And The Fate Of America's Fresh Waters [Review Of Book By Robert Glennon], Robert H. Abrams

Journal Publications

This is a fun book to read. Most books of this genre decry a serious environmental problem and seek to influence a particular legal response to it. Those books tend to be long on details and heavy-handed in their advocacy. Many operate on the premise that the solution being presented requires an active effort at persuasion to convince the reader of the proposal's worth. This book is better: it tells fascinating stories, weaves together a series of poignant vignettes, and guides the reader to the desired conclusion implied by the book's title-America's water law in relation to groundwater pumping is …

The Promise And Perils Of "Our" Justice: Psychological, Critical And Economic Perspectives On Communities And Prejudices In Mediation, Clark Freshman

Cardozo Journal of Conflict Resolution

Looking for justice in mediation often depends on the lens. Critics of mediation often measure mediation against an idealized court system and find mediation lacking. Many proponents of mediation, including many contributors to the Cardozo Symposium on Mediation and Justice, argue mediation promotes justice by promoting different values from alternatives like the courts: it may promote the autonomy of the parties by letting them make choices, it may lead to more creative settlements; it may lead to greater satisfaction; it might be less expensive.

New Sources, New Growth And The Clean Water Act, Jeffrey M. Gaba

Faculty Journal Articles and Book Chapters

This Article is discusses the means by which the federal Clean Water Act addresses the problem of growth in connection with the achievement and maintenance of water quality standards. The article discusses those existing water quality standards requirements that most directly affect the issue of growth. These include two distinct, and largely unrelated, sets of requirements. First, the Article discusses those provisions that affect the regulation of new or expanded discharges on waters not yet meeting water quality goals. These include, among others, the provisions of the TMDL process that address the allocation of waste loads to account for growth, …

International Marine Environment Law: A Case Study In The Wider Caribbean Region, Benedict C. Sheehy

ExpressO

Abstract: This study examines the effectiveness of international marine environment law in controlling and abating contamination of the marine environment in the Wider Caribbean Region. The main international agreement covering the region is the Cartagena Convention which came into force in 1983. This convention, initiated by the UNEP under its Regional Seas Program, is considered one of the most successful of the programs. The study examines that claim in light of events since the adoption of the Cartagena Convention by the majority of nations bordering on the region. Mexico, because of its stature as a leading Latin American nation, is …
