Life, Liberty, And The Pursuit Of Water: Evaluating Water As A Human Right And The Duties And Obligations It Creates, Amy Hardberger
Faculty Articles
The Right to Water should be an independent, explicit human right. As such, the status of the right to water would be raised to the status of customary international law (jus cogens), imposing an affirmative, obligatory duty an all nations. Historically the right to water has been included in the right to life, limiting the right; however, that approach undermines the essential importance of water and causes enforcement problems that would be avoided by regarding water as an independent right.
Landmark international agreements, treatises, and the work of various international entities and other non-governmental organizations have made tremendous strides in …

Can The Farmers Sue Uncle Sam When The Bureau Of Reclamation Reduces Deliveries To The Water District?, Robert H. Abrams
Journal Publications
Are farmers who have received water from an irrigation district "intended" third-party beneficiaries of that water district's service and repayment contracts with the United States Bureau of Reclamation and, therefore, within the scope of a waiver of sovereign immunity that would otherwise bar a suit by the farmers against the Bureau of Reclamation?
Indigenous Peoples' Rights To Water Under International Norms, David H. Getches
Indigenous Peoples' Rights To Water Under International Norms, David H. Getches
Publications
In this article, Dean Getches examines the nature of international law as it relates to indigenous water rights and evaluates the kinds of claims that native peoples might assert when they are deprived of access to water. Around the world, indigenous peoples have experienced depletion or pollution of their traditional water sources caused by the uses made by dominant, non-native societies. As a result, native peoples' ability to perform water-dependent vocations like farming and fishing, and to perpetuate cultures and spiritual practices requiring water is limited. While a few countries recognize water rights of indigenous peoples in their domestic laws, …

Protecting A Hidden Treasure: The U.N. International Law Commission And The International Law Of Transboundary Ground Water Resources, Gabriel E. Eckstein
Faculty Scholarship
Ground water is the most extracted natural resource in the world. It provides more than half of humanity's freshwater for everyday uses such as drinking, cooking, and hygiene, as well as twenty percent of irrigated agriculture. Given the world's considerable reliance on this precious resource, it is reasonable to assume that international attention to, and especially legal consideration of, ground water would be substantial. Nothing is further from the truth. Despite the growing dependence, legal and regulatory attention to ground water resources have long been secondary to surface water, especially among legislatures and policymakers and above all in the international …

Marine Ecosystem Management & (And) A Post-Sovereign Transboundary Governance, Bradley Karkkainen
Marine Ecosystem Management & (And) A Post-Sovereign Transboundary Governance, Bradley Karkkainen
San Diego International Law Journal
This paper argues that for purposes of managing transboundary environment problems in general, and marine ecosystems in particular, the role of international law as traditionally understood is somewhat overrated. Binding international legal obligations owed by states to other states often turn out to be a good deal less important in environmental problem solving than is commonly supposed by many international lawyers, legal scholars, and environmental NGOs (non-governmental organizations). Specifically, this paper argues that emphasis on binding multilateral environmental agreements among sovereign states is often misplaced and possibly even counterproductive, insofar as it threatens to divert attention from more promising strategies …

Water is one of the scarcest natural resources on our planet. Yet, it is one of humans' most vital needs This gift of nature has been a cause of tension and confrontation in many parts of the world due to the lack of a shared vision for its optimal and rational use Among the great water bodies, the Nile basin has been cited as one of the major trouble spots Recently, the Nile basin states have started to cooperate under the auspices of the Nile Basin Initiative for sustainable and equitable approach to Nile water use. This article discusses some …

Who Gets The Hooch?: Georgia, Florida, And Alabama Battle For Water From The Apalachicola- Chattahoochee-Flint River Basin, C. Hansell Watt Iv
Mercer Law Review
During a time when technology is constantly changing and becoming more advanced, one of the constants that our planet, and all of the creatures on it, will always rely upon is fresh water. Throughout history, rivers have been the lifeblood that supports cities by providing drinking water, irrigation, transportation, trade, recreation, power, and many other industrial and domestic uses. As the human population grows, rivers and lakes are more pressured to support the growing needs of the communities and cities that rely on these bodies of water. Because many rivers in the United States flow across numerous states, problems develop …
