The prior appropriation doctrine has governed the allocation and use of water in the western United States since the 1850s. The shifting nature of water demand is bringing about changes in the traditional legal system. This conference will consider the fundamental principles of the prior appropriation doctrine together with the important new developments in the law now underway throughout the West.

The Arcata Volunteer Fire Department was organized on January 24 1884 in response to a growing awareness that the pump-and-bucket operation on the town's Plaza was inadequate to protect the business district. A necessary part of that new department, of course, was a dependable water system; the organization of the Union Water Co. took place in December 1883. This report covers the establishment and history of the Union Water Company.

Unused Riparian Water Rights In Washington—Department Of Ecology V. Abbott, 103 Wn. 2d 686, 694 P.2d 1071 (1985), Lynn B. Squires

In Department of Ecology v. Abbott, the Washington Supreme Court addressed the long-standing question of whether landowners who failed to exercise consumptive riparian rights3 within a reasonable period after the adoption of the Water Code of 1917 (1917 Code) lost those rights. The question arose when a riparian landowner, who had registered consumptive water rights as required by statute in 1971, was denied those rights in a 1982 stream adjudication. The basis for the denial was that the landowner's riparian rights had not been continuously exercised since 1917. The Water Rights Registration Act, with which the landowner complied in 1971, …

The water resources of the Great Lakes Basin are precious public natural resources, shared and held in trust by the Great Lakes States and Provinces. Why I Teach Water Law, Joseph L. Sax

I began my first law school job in 1962 and water law is the only subject I have taught every year since then. Though I am enthusiastic about all the courses I teach, I confess that water law remains my favorite. I have often asked myself why, because few subjects are considered more peripheral to the central mission of the law schools. In the East and Midwest the course is rarely taught, and in the West-where it has long been a staple- it is pretty much treated as a "nuts-and-bolts" offering for students who will practice in appropriation doctrine states. …

Indian Allotment Water Rights, Richard B. Collins

Allotted tribal lands create troublesome questions for western water lawyers. In this article the author reviews the history of basic Indian reservation water rights created by the Supreme Court's landmark decision in Winters v. United States. He then explains the disposition of those rights when reservation lands are allotted. Finally, he discusses the difficult issues that arise when allotted lands pass from the federal trust become subject to state law, and are transferred to non-Indians.
