The success of the democratic process depends on a fair, efficient, and open electoral system. Professor Kerstein studied Florida's election process during a seven-month residency at the Florida State University College of Law Policy Studies Clinic. In this Article, derived from his final report, Professor Kerstein evaluates the election process and suggests ways to improve it.

During the 1986 Survey year, a number of cases of interest to practitioners were decided by the courts of New York. There have been several new legislative enactments which will also have a direct impact upon the practice of tort law. These enactments are analyzed elsewhere in this Survey volume. Following past practice, cases of the greatest significance will be highlighted, as well as those oddities which make tort law a stage for the human comedy.

Choosing The Appropriate State Statute Of Limitations For Section 1983 Claims After Wilson V. Garcia: A Theory Applied To Maryland Law, Stephen J. Shapiro

Forty-two U.S.C. section 1983 provides individuals with a federal cause of action for violations of their constitutional rights by persons acting under color of state law. The statute itself contains no limitations period for the filing of suits and, in keeping with settled federal practice, the lower federal courts have looked to state law to determine the proper limitations period. Because the lower courts adopted various inconsistent approaches to determining the appropriate state limitations period, the Supreme Court, in Wilson v. Garcia, held in 1985 that the federal courts should adopt the state limitations period for personal injury actions. In …

The Effect Of Tax Foreclosure Sales On Servitudes: Olympia V. Palze, Daniel W. Galvin

This Note analyzes the historical position taken by Washington courts regarding servitudes and tax sales prior to and subsequent to the 1959 statute dealing with easements. The Note next examines the Palzer holding, the degree to which it aligns Washington's position with that of the majority, and its limited support for future litigation involving other forms of servitudes.
