On November 4, 1980 the citizens of Massachusetts, by a vote of 59% to 41%, resoundingly endorsed a tax reduction plan known as Proposition 2 1/2. All communities in the Commonwealth were faced with an immediate reduction in their local revenues due to the immediate cut in the excise tax that Proposition 2 1/2 called for, and up to 130 communities will have to implement a 15% reduction in their tax levies for FY 1982.
Already there are protestations from many local officials that they cannot make the required tax cuts without severely reducing the level of local services. The …

The tremendous growth of government occasioned by greater involvement in the social and economic life of the nation has been the cause of many concerns. Two perennial concerns have been the extent to which the government can prevent public access to information on the basis of which policies and decisions are made and the possibility for misuse by the government of information private to individuals or business firms. The routine tasks of mammalogists whose research or curatorial activities include collecting, importing, processing, exporting, or interstate transporting of living or dead scientific specimens of mammals have become increasingly complicated by newly enacted (or more rigorously enforced) Federal regulations. These regulations were necessary largely because of the activities of non-scientists, but their provisions have had a tremendous impact on the activities of scientists (especially museum-based systematists and ecologists). Most mammalogists have expressed a willingness to comply with the regulations (although nearly all agree that administration of the permit system should be consolidated into a single office) if they can obtain …

In 1943, the Indiana Legislature created a Stream Pollution Control Board;' in 1961, it created an Air Pollution Control Board; and then in 1972, the Legislature created an Environmental Management Board to coordinate and facilitate the efforts of the air and stream boards. The concern within the State Legislature for the environment reaches back more than two decades, and it would appear that the policy of the State is to become progressively more active in this area. The purpose of this discussion is to demonstrate how the initiative power may be employed by citizens wishing to pass a law independent of the state legislature. Although the initiative power is granted in many state constitutions, in the past it has been used sparingly. However during these days of political activism the initiative power has been given new vitality. For example, in the area of environmental law it has been employed by citizens groups in such states as California, Illinois, and Wisconsin to reserve greater individual rights against environmental polluters.

This report recommends that the administration and/or financing of a selected group of public services be shifted from municipalities to the state government in Massachusetts.
Several criteria are used to identify local functions and local fiscal responsibilities which are more suitable for state than local financing. The first criterion is the efficiency of delivery of the service: for some functions, such as solid waste disposal, technology makes it more costly per capita to provide the service separately through individual municipalities than to operate regionally-based waste disposal facilities. Designed as a comparative undertaking by the National League of Cities (NLC) , this study is officially entitled "National Research Agenda Project No. 5: Substandard Housing and the Cost of Providing Housing-Related Services." A similar study was carried out by the urban observatories in Denver and Nashville. According to the study scope of services, the NLC was interested in the cost of "a wide variety of local government activities ... required to support and service urban housing," and how these costs "are affected by housing quality, housing location, age and type of structures. ..." This report on municipal manpower in the City of Boston is one of a series of Urban Observatory studies designed to improve the effectiveness of City policies and programs. Focusing on the City's requirements for administrative, professional and technical staff, the study examines current patterns and problems, identifies existing strengths and weaknesses, and offers a number of recommendations aimed at upgrading municipal performance by expanding the cadres of qualified staff. While the findings identify serious deficiencies, they also point to opportunities for effecting substantial change over the next decade. This study is a preliminary evaluation of the relative impacts of various City policies and programs related to the enforcement of housing codes and to the maintenance and upgrading of the existing supply of housing. It analyzes code enforcement functions at both the level of central administration and field procedures. City departments covered by the study include Housing Inspection (HID), Building, and the environmental unit of Health and Hospitals. Also reviewed are newer approaches to housing code enforcement, including civil remedies and federally-assisted concentrated code enforcement projects.

Increasingly in recent years, discussion of the appropriate division of responsibilities between the nation and the states has shifted from ideological to pragmatic grounds. One consequence of that shift has been to bring into sharper focus the dilemma which confronts the growing number of those who believe that the existing structure of government is inadequate to the pressing tasks which face the nation, especially those tasks which center upon the metropolitan areas now inhabited by two-thirds of the nation's population. Municipal Corporations - Validity Of Covenant To Maintain Parking Meters In Bond Issue To Finance Off-Street Parking Facilities, William G. Cloon, Jr. S.Ed.

An act of the state legislature authorized the issuance of municipal bonds to finance off-street parking facilities. The city was authorized to pledge revenue from existing on-street parking facilities to service the bonds but was to retain the right to change the location of the parking meters and other on-street facilities for enumerated reasons so long as the change did not materially lessen the revenue to be derived from those facilities. Acting in pursuance of authority granted by the enabling act, the city covenanted to maintain its parking meters subject to the reservations required by the act. In an action …
