The legal standing of joint statements in international law remains contested, particularly with respect to their qualification as treaties under the Vienna Convention on the Law of Treaties. This issue has become increasingly relevant following the 2024 Joint Statement between Indonesia and China on Advancing the Comprehensive Strategic Partnership and the China-Indonesia Community with a Shared Future. Despite its political framing, item nine, which contains a provision on joint development in areas described as overlapping claims in the South China Sea, raises critical legal concerns that the implications may constitute a legally binding treaty. The integrated administrative dispute resolution system in Indonesia positions Administrative Proceedings as the primum remedium and the State Administrative Court as the ultimum remedium. This system is intended to provide comprehensive legal protection for citizens. However, in practice, it can lead to prolonged and ineffective dispute resolution processes, thereby limiting citizens' access to defend their rights before the the Administrative Court. This study analyses an effective integrated state administrative dispute resolution system that ensures legal protection for citizens. Improving Judicial Reasoning In Constitutional Rights Cases: The Case For A Structured Proportionality Test In The Indonesian Constitutional Court, Muhamad Dzadit Taqwa
Padjadjaran Jurnal Ilmu Hukum (Journal of Law)
This study evaluates the structured proportionality test modelled after the German approach. It argues that the Indonesian Constitutional Court should adopt this test when reviewing statutory limitations on constitutional rights under the amended 1945 Constitution. While the structurally weak protection of constitutional rights in the Constitution provides the contextual motivation for this inquiry, the central focus is instrumental: to assess the benefits and challenges of proportionality as a tool for improving judicial reasoning in constitutional rights adjudication. The analysis identifies three key benefits, including enhanced problem identification, improved justification of legislative limitations, and strengthened methodological rigor in judicial decision-making. This study examines Lebanon’s Law on the Organization of the Judicial Court System, adopted by the Chamber of Deputies on July 31, 2025, and returned to the Chamber by the President of the Republic for further discussion, on September 5, 2025. It represents one of the most significant judicial reform initiatives since the Taif Agreement of 1989. The study traces the evolution of the Law’s provisions in successive drafts in light of the recommendations of the Venice Commission – the advisory body to the Council of Europe – and international standards regarding both institutional and individual judicial independence. Genocide embodies the ultimate transgression of international law and exposes the limits of its effectiveness. Based on the 1948 Convention, its legal framework rests on two constitutive elements, – material and mental – whose interaction determines the recognition of the crime. Recent jurisprudence and contemporary cases in Gaza highlight the tension between legal clarity and political failure. Beyond punishment, prevention and the duty to ensure respect for international humanitarian law emerge as the core challenges of a system in crisis, where the survival of law now depends on its capacity to restrain power. The independence of the judiciary in Lebanon, as constitutionally guaranteed, carries a particular meaning that is embodied exclusively in the judicial function performed by any sitting judge issuing rulings in the name of the Lebanese people. The Constitution that elevates the judiciary to the level of a power does not provide itself for guarantees akin to the legislative and executive branches. Rather, it entrusts the determination of judicial safeguards to the legislature, under the oversight of the Constitutional Council. The Lebanese administrative judiciary is undergoing a profound crisis, exacerbated by the broader institutional disintegration affecting the country. This crisis appears rooted in deeper and more specific causes: an alleged original illegitimacy of the institution and the recurrent instabilities that have marked its development. Today, this branch of justice operates at a minimal level, remains dependent of the executive, and struggles to fully guarantee the right to a fair trial. The centenary of the Lebanese Conseil d’Etat, established in 1924 on the French model, offers an opportunity to reflect on its role in the development of law. This institution, which embodies the dual jurisdictional system characteristic of legal systems inspired by French law, has a dual mission – advisory and judicial – making it a central actor in the creation of law. In its advisory function, it provides the government with guidance on the legality and administrative advisability of draft texts. Defining and measuring the concept of judicial independence, often a source of contradictions, is crucial to ensure that the reform of the judicial system genuinely leads to the protection of the independence of judges and justice. This article puts forward three essential points: 1. Judicial independence is a measurable concept based on a set of specific guarantees; 2. It is also a complex concept, encompassing multiple facets that must be protected simultaneously; 3. Ultimately, it stems from legislative (and possibly constitutional) recognition of these complementary guarantees rather than from a moralizing discourse imposed on judges.

The Marxist theory of the law is underdeveloped compared to the rest of Marx and Engels works. This can be chalked up to legal systems merely being part of the superstructure, by which the ruling class use to maintain power. In this essay I push back on this notion that the rule of law can be dismissed, arguing that if Marx's true community is to be as such then the addition of a just legal system is not an issue. How should a military officer respond to a lawful yet unethical order, unethical in the sense that it conflicts with their professional responsibilities? Army culture, scholarship, and doctrine regard officers as professionals, akin to doctors and lawyers, with expertise in the management of violence and a shared commitment to an ethical code. This code demands obedience to lawful orders to uphold civilian control of the military. But to protect against civilian misuse of the military, the code requires disobedience to unethical orders. This research examines the legal issue concerning the administration of regional government in Nusantara Capital City (IKN) which has been consider by some scholars as demonstrating deviations from the principle of decentralization. This research takes a position contrary to the mainstream legal discourse that argues there is a conceptual deviation in the model of regional governance in IKN.
