Considering that private sector single employer defined benefit pension plans must be fully funded by law, the legal issue emanating from their systemic underfunding is whether or not actuaries have been using their discretion in a manner which is within a reasonable interpretation of the margin of manoeuvre contemplated by the legislature, in accordance with the principles of the rule of law. This dissertation investigates the relationship between marital history and individuals’ retirement resources, namely Social Security, employer-sponsored pensions, and non-housing wealth. Prior research provides a foundation for understanding marriage’s positive relationship to retirement security, and suggests that marriage is financially beneficial and can even lessen some external factors that would otherwise damage a family’s financial situation. Yet changing demographics, with fewer people in first marriages and rising numbers of individuals experiencing divorce and choosing to remain unmarried, suggest our understanding of this relationship for today’s retirees may be limited. One in five Americans has a disability, making it the largest minority group in the U.S. (Soffer, McDonald, & Blanck, 2010). In 2011, 13.4 million working-aged adults received a disability cash benefit from the Social Security Administration (Kregel, 2012).
The Social Security Administration (SSA) is the federal agency responsible for managing, executing and overseeing retirement, survivor, old-age and disability benefits. There are over 1,500 Social Security offices and over 65,000 employees nationwide (SSA, 2013). There are two primary areas related to retirement income security: pension systems and inflation-indexed bonds. Pension systems fall into three categories: public, corporate, and individual pensions. The purpose of this study is to examine the adequacy of benefits provided by the Employees Provident Fund to its members. A sample of 21,722 members who have attained the age of 54 years and actively contributing to the fund were selected for the study. The study shows that the old age retirement benefit scheme provided by the Employees Provident Fund to its members is grossly inadequate and does not meet to the standard established by the I LO convention No.102 of 1952 on replacement income retirees.
