Forfeiture: General State Of The Law And Movement To Further Confine Its Application In The Coal Lease, Linda Rae Arimez
West Virginia Law Review
Recent case law developments in Ohio and West Virginia have narrowed the application of forfeiture in obtaining the termination of a coal mining lease for breach of express and implied covenants. This Note examines the law of forfeiture generally, and later discusses these recent cases and their ramifications.

The Rule Of Capture: Government And The Oil Industry, Joseph P. Tomain
The Rule Of Capture: Government And The Oil Industry, Joseph P. Tomain
Faculty Articles and Other Publications
The Oil Follies of 1970-1980 by Robert Sherrill, is a broad account of an important decade for energy law and politics. In a capsule review of the book, I noted that it is a journalistic, rather than an academic, look at the theory of capture as a way of talking about government regulation. Because Sherrill was writing for a predominantly lay audience, he did not undertake a systematic and rigorous analysis of the legal regulations concerning the petroleum industry. Nevertheless, his book does provoke a serious question: Is Big Oil bad, and if so, how should government regulate it? This …
Subchapter S As A Vehicle In Real Estate And Oil & Gas, Lorence L. Bravenec
Subchapter S As A Vehicle In Real Estate And Oil & Gas, Lorence L. Bravenec
Akron Tax Journal
This article discusses several significant problem areas faced in real estate and oil & gas activities under the new rules for S corporations enacted by the Subchapter S Revision Act of 1982 (hereinafter the "1982 Act"),' as modified by the Tax Reform Act of 1984 (hereinafter the "1984 Act"). The 1982 Act brought the taxation of S corporations and shareholders more in line with the partnership model, thus making the law conform more to the expectations of the parties. At the same time, the 1982 Act removed many of the serious pitfalls and the sought after planning devices under the …

Energy From Canada's Frontier: A Fading Dream?, John Bishop Ballem Q.C.
Energy From Canada's Frontier: A Fading Dream?, John Bishop Ballem Q.C.
Dalhousie Law Journal
By the end of the present century, oil and gas from Canada's frontier should comprise a substantial proportion of our total energy supply. The economic activity generated by the huge capital investments required to utilize these resources should have done much to improve Canada's economy. However, whether these desirable goals will, in fact, be achieved is still very much an open question. Ordinarily, the fundamental uncertainty in dealing with oil and gas concerns whether or not these elusive substances actually exist in the area being searched. In the case of frontier oil and gas, however, the real question is not …
