Mines And Mining--Extralateral Right Where Vein Enters Side Line Of Location
Mines And Mining--Extralateral Right Where Vein Enters Side Line Of Location
Michigan Law Review
ln Rico-Argentine Mining Co. et al v. Rico Consol. Mining Co. et al. 74 Colo. 444, the supreme court of Colorado states some interesting propositions of mining law, one of which, at least, seems of rather dubious validity. A suit was brought by the owner of the Allegheny mine to recover for (and to enjoin) a trespass on its property by the owner of the Blackhawk and 'Wide Awake mines, which adjoined the Allegheny on its westerly side. The Blackhawk and Wide A wake locations were senior to the Allegheny, and their owner claimed the right to the minerals under …
Constitutionality Of Acts For Conservation Or Retention Of Natural Gas Within The State
Constitutionality Of Acts For Conservation Or Retention Of Natural Gas Within The State
Michigan Law Review
The distribution of our natural resources creating among our several states an economic inter-dependence of varied degrees, and the growing appreciation of the danger of approaching exhaustion in various fields, has very naturally prompted the legislatures of some of the states to enact statutes which have been broadly designated as "conservation acts," though some of them could be described more accurately as "domestic preference acts". Most of these statutes are calculated to prevent waste, arc real conservation measures, and have nearly always been upheld. Ohio Oil Co. v. Indiana, 177 U. S. 190, concerned a statute making it unlawful …

Constitutional Law--Police Power, Regulation, And Confiscation
Michigan Law Review
Whether the power be taken away directly, or be deadened and atrophied in its action by adverse criticism and demagogic clamor, when the judiciary no longer feel at liberty to construe the provisions of the fundamental Law 'in the light of reason,' constitutional government, in the sense in which it has been understood for a century and a half, will be at an end, and the doctrine of the police power will have been swallowed up in the capacious maw of unrestrained democracy." 27 HARV. L. REV. 316. Mr. Wickersham penned this warning during the period when the swell of …

Carriers of Passengers - Duty to Stop at Station to Permit Passenger to Alight-Contributory Negligence of Passenger Plaintiff's intestate was riding in the front end of a crowded vestibule car in the coach next to the tender of the eengine. When the train stopped at his station he tried to leave by the front end, but found the door from the vestibule closed. As he did not know how to open it, or was unwilling to be carried by his station, he stepped from his platform to the bumper of the tender and tried to follow it to the side …
Law Of Oil And Gas, Iv, James A. Veasey
Law Of Oil And Gas, Iv, James A. Veasey
Michigan Law Review
This clause follows the grant, and is one of the most distinctive features of the modern oil and gas lease. Occasionally the duration of the lease is fixed by the granting clause; some times by a miscellaneous provision appearing therein. But generally speaking, the habenduin defines the term of the present-day oil and gas lease. At any rate a discussion of the legal effect of the habendum clause which now characterizes these instruments will involve the treatment of every important question which arises under this heading. At the outset we should observe that the clause is the direct result of …

Law Of Oil And Gas, James A. Veasey
Michigan Law Review
The questions heretofore considered are general in their scope, and were treated for the purpose of providing a background for the more intensive study upon which we must now enter. While commentators refer to this branch of jurisprudence as the "Law of Oil and Gas," it is more exact to say that .we are dealing with the law pertaining to oil and gas leases. This is true because the oil and gas lease characterizes and distinguishes the subject throughout. For reasons which inhere in the very nature of the business a lease yielding the lessor a royalty on the quantity …

Law Of Oil And Gas, James A. Veasey
Michigan Law Review
No thoughtful observer will presume to gainsay the all-important part which the oil business plays and will continue to play in the industrial, commercial and social life of the civilized world. Long before the great war this fact was deeply impressive, and was generally recognized. At the end of that conflict it was said with much truth that the Allies had floated to victory upon a sea of oil. Now, standing as we are at the threshold of a new era rich in industrial and commercial promise, no man can foresee nor even approximate the mighty expansion which will characterize …

If The Lines Of A Junior Lode Location Be Laid Across The Surface Of A Valid Senior Location Will The Junior Location Acquire Extralateral Rights Based On A Portion Of The Vein Which Is Included Within The Senior Location As Against Another Earlier Location Covering The Dip Of The Vein, Myron A. Folsom
Michigan Law Review
It was decided in Del. Monte M. & M. Co. v. Last Chance M. & M. Co.,: that the lines of a junior lode location may be laid upon the surface of a valid senior location (if done openly and peaceably), for the purpose of securing extralateral rights on the dip of a vein the apex of which is within the second and outside of the first. But the court declined to decide whether the junior locator would acquire any extralateral rights based upon a portion of the apex covered by the senior location, saying "Perhaps the rights of the …

The Anthracite Coal Industry And The Busness Affected With A Public Interest, Andrew Alexander Bruce
Michigan Law Review
The constitutions, state and federal, do not anywhere guarantee any absolute property rights nor right to liberty. The guarantee is merely that no person shall be deprived of life, liberty and property without due process of law. The right to liberty and property was never absolute under the English law, and the American constitutions have never been construed as going further than guaranteeing the continuance of the rights which existed at the time of their adoption.
