The law of Washington concerning the interests conveyed by timber deeds and contracts is foggy. Many vital questions are still totally unanswered, or have been left in confusion, by the cases in point. The principal area of doubt revolves around the question of whether standing timber, which has been sold separately from the land on which it stands, is realty or personalty. The answer is vital for many reasons. One of the most important statutes enacted in the 1949 session of the Washington legislature is Chapter 112 of the 1949 Session Laws, which, with its complement, Chapter 107, forms the new Fisheries Code of the state, replacing the old provisions which had been in effect with variations since 1915. The new Code is singular, not only in the very broad administrative powers given to the Director of Fisheries, an office created by the Act, but also by virtue of the fact that certain of its licensing provisions were inserted in apparent defiance of three recent United States Supreme Court …

Lawyers of the Pacific Coast and all lawyers dealing with international law will be interested in President Truman's proclamation of September 28th, wherein he sets forth a constructive policy for the control and conservation of the coastal fisheries of this and other nations. Thus is brought to consummation a campaign originating on this coast some ten years ago to demand that our government review the subject of ocean fisheries and adopt an affirmative policy consistent with existing facts and a rational interpretation of international law.

Presumably, to a lumberman, a manufacturer, a wage earner or an investor a stand of trees is just a given number of trees of various types, or, perhaps better, a given quantity in board feet of merchantable lumber, which can be profitably converted into money as and when proximity to market and market price permit. More broadly, to a conservationist, trees in various stages of growth are national assets capable of continuous reproduction and the source of a constant as well as an immediate supply of material for structural and other uses. Control Of Fisheries Beyond Three Miles, Edward W. Allen

Our Pacific Northwest has attained worldwide recognition from the fact that here a successful system was initiated by two independent nations for the conservation of a deep sea fishery. Now it appears probable that the threatened disruption of this system may in turn give birth to new conceptions of international law. Strictly legal phases of this situation are so interwoven with the economic and the diplomatic that a factual as well as a legal background is essential to their complete appreciation.
