The Right To Privacy And Data Protection In Times Of Armed Conflict, Asaf Lubin, Russell Buchan
The Right To Privacy And Data Protection In Times Of Armed Conflict, Asaf Lubin, Russell Buchan
Books & Book Chapters by Maurer Faculty
Contemporary warfare yields a profound impact on the rights to privacy and data protection. Technological advances in the fields of electronic surveillance, predictive algorithms, big data analytics, user-generated evidence, artificial intelligence, cloud storage, facial recognition, and cryptography are redefining the scope, nature, and contours of military operations. Yet, international humanitarian law offers very few, if any, lex specialis rules for the lawful processing, analysis, dissemination, and retention of personal information. This edited anthology offers a pioneering account of the current and potential future application of digital rights in armed conflict.

The Culture Police: Manning The Barricades Of Allowable Art And Culture, Ramy Aly
Faculty Book Chapters
In this chapter I look at the history and ontology of censorship in Egypt from the Monarchical era to the present. I focus on the post-1952 era and how a tutelary state culture has been deployed as part of a broader cultural militarism. The chapter also covers the legislative architecture that has ensured a stranglehold on the part of syndicates and the creation of a broad range of crimes associated with art and culture production and exhibition.

U.S. competitors pursuing meaningful revision or rejection of the current U.S.-led status quo are employing a host of hybrid methods to advance and secure interests contrary to those of the United States. These challengers employ unique combinations of influence, intimidation, coercion, and aggression to incrementally crowd out effective resistance, establish local or regional advantage, and manipulate risk perceptions in their favor. So far, the United States has not come up with a coherent countervailing approach. It is in this “gray zone”—the awkward and uncomfortable space between traditional conceptions of war and peace—where the United States and its defense enterprise face …

The Nseers Effect: A Decade Of Racial Profiling, Fear, And Secrecy, Penn State Law Immigrants' Rights Clinic, Rights Working Group
Center for Immigrants' Rights Clinic Publications
n the wake of the tragic attacks of September 11, 2011, the landscape of immigration law and policy in the United States changed dramatically as the government scrambled to create counterterrorism programs to respond to potential national security threats. One program is the National Security Entry-Exit Registration System (NSEERS) or "special registration" that was initiated by the Department of Justice in 2002 and inherited by the Department of Homeland Security in 2003. NSEERS served as a tool that allowed the government to systematically target Arabs, Middle Easterners, Muslims, and South Asians from designated countries for advanced scrutiny. ...The purpose of …
Efficiency In Bello And Ad Bellum: Making The Use Of Force Too Easy?, Kenneth Anderson
Efficiency In Bello And Ad Bellum: Making The Use Of Force Too Easy?, Kenneth Anderson
Contributions to Books
This article criticizes a widely asserted claim that drones make the resort to force and violence — war — “too easy.” Attractive on the surface to many, this article says that “too easy” is not a coherent notion as applied in war. The “too easy” argument comes in two forms, a moral argument and a maximization of social welfare argument. The maximization of social welfare version (on which the article focuses) frames “too easy” as a matter of creating an “inefficient” level of disincentive to use of force on account of insufficient risks to one’s own forces in so doing …
