Using A Prediction Model In Forecasting Appeals, Paul A. Rake
Using A Prediction Model In Forecasting Appeals, Paul A. Rake
IUSTITIA
Following the 1972 reorganization of the Indiana Court of Appeals into three panels serving defined geographical districts, the Court soon found itself floundering with too many unevenly distributed cases. Lacking a sufficient base of statistical data from which to formulate a plan to cope with the problem, various proposals, including redistricting the court, adding more judges, and developing a more sophisticated staff research, could not be measured for effectiveness or advisability.
In response to these problems, the Court developed a project to deal with the future caseload by constructing a regression model to predict appeals. This model generated estimates of …

Collective Hindsight: A Review Of The Grass Roots Primer, Jenifer Robison
IUSTITIA
What do you do when the U. S. Army Corps of Engineers announces that its solution to the hurricane "problem" in New York (four major hurricanes in 200 years) is to build a wall around Coney Island? How do you fight it when a local landowner secures a zoning variance so he can open a game farm whose main access (for its projected 300,000 visitors in 100,000 cars) is the only street in your tiny village? In the days before the citizen's suit provisions of the present environmental laws there was very little recourse for people outraged by plans like …
A Review: The Interaction Of Law And Religion, Frona Powell
A Review: The Interaction Of Law And Religion, Frona Powell
IUSTITIA
In 1971 at Boston University, Harold J. Berman, Story Professor of Law at Harvard Law School, delivered four lectures in the series of Lowell Lectures on Theology. This book is comprised of those lectures with an introduction, postscript, and annotations. One would hope that Berman's analysis of the interaction of law and religion would provide insight into an area which is often neglected by modern jurisprudents. Unfortunately, it does not.
Those who are members of the legal profession as well as those who are not, are aware of the fact that the legal system does not always function properly. In …

Marriage In An Age Of Possibility: Joseph Epstein's Divorced In America, William I. Fine
Marriage In An Age Of Possibility: Joseph Epstein's Divorced In America, William I. Fine
IUSTITIA
Ever since the William Loud family first exhibited their marital difficulties on the Public Broadcasting Service, there has been a new direction in the popular literature on American divorce. In the past, the study of marital breakdown relied heavily on a foundation of case studies and empirical data. As society became more complex and variable, permutations from the basic theories became inextricably confused. Often the validity of a research technique would become a greater point of controversy than the results achieved. The product was a contradictory and prematurely dated body of knowledge in which no conclusive evidence could be assembled …
Professionalizing Legislative Drafting: A Realistic Goal?, Reed Dickerson
Professionalizing Legislative Drafting: A Realistic Goal?, Reed Dickerson
Articles by Maurer Faculty
The teaching of skills that result in sound legislative drafting is neglected in law schools, and professionalism in legislative drafting is lacking on both the federal and state fronts. With the adoption by the American Bar Association of seven major principles relating to the drafting of federal legislation, perhaps there is more hope now that there will be a move toward professionalism.
Literature And Law: How The Literary Quality Of A Political Statement Has Affected The Development Of Law In Tanzania, Robert L. Scott
Literature And Law: How The Literary Quality Of A Political Statement Has Affected The Development Of Law In Tanzania, Robert L. Scott
IUSTITIA
The purpose of this inquiry is to demonstrate how the literary qualities of a political statement have contributed to the legal and economic development of an African nation.
It is my contention that a literary statement* is a useful tool in representing the process of events in a manner which reproduces the quality and character of the underlying reality. This more accurate reality is derived from the perspective of the artist who writes out of an experience common to his people, even though his expression is essentially a personal one: he writes according to his own sensibilities and is not …

Statutory Interpretation: The Uses And Anatomy Of Context, Reed Dickerson
Articles by Maurer Faculty
Every communication that is generated by a written instrument consists of two elements which must be considered in arriving at the meaning of the communication. Those elements are: (1) the written vehicle itself, and (2) its surrounding context. The surrounding context which thus completes the communication consists only of those underlying cultural aspects which, when considered in relation to the written vehicle, are: (1) relevant to the written vehicle, (2) reliable, (3) shared by the author and the audience, and (4) relied on by both author and audience to complete the communication. The author suggests that those cultural elements which …
