Democracy Requires Good Law Libraries – With Books, Franklin L. Runge

In this brief commentary, the author argues for the continued presence of a print collection in law libraries because (1) law libraries serve as a fail-safe for democracy, (2) inexperienced researchers achieve a greater understanding of how primary law is produced when exposed to print materials, and (3) there is still a high demand for print materials in scholarly endeavors.

A Review Of Grey Literature Cited By Food Loss Law And Policy Scholarship, Angela Hackstadt

In the United States, state and federal programs, rules, and legislation attempt to address the social, economic, and environmental impacts of food waste. Research on the efficacy of these interventions rely on a variety of grey literature resources. Grey literature is valuable to policy research but may be overlooked because it is not published commercially and is often deemed unauthoritative. This review focuses on the use of grey literature in food waste law and policy scholarship to identify the most used sources and to determine what, if any, archiving strategies authors use. Recommendations for librarians and researchers are discussed.

Ecological And Holistic Analysis Of The Epistemic Value Of Law Libraries, Paul D. Callister, Dana Neacsu

We examine the libraries' roles within the "epistemic foundation of society.” Our analysis is in response to the omission of Yale Law Dean Gerken of the role of libraries in her recent article about legal education's new focus and to remarks by AALS President Vicki Jackson that suggest an uncertain role for libraries. We have adapted holistic ecological media theory, as developed by Ronald Deibert, to reject a technologically deterministic view of libraries as having no future. May It Please The Court: A Longitudinal Study Of Judicial Citation To Academic Legal Periodicals, Brian T. Detweiler

Part I of this article examines the proportion of reported opinions from U.S. federal and state courts between 1945 and 2018 that cite at least one academic legal periodical, while Part II applies that data beginning in 1970 to compare the proportion of opinions that cite to the flagship journals of 17 law schools selected and hierarchically categorized based on their U.S. News & World Reports rankings. Renowned legal educator Roscoe Pound stated, “Law must be stable and yet it cannot stand still.” Yet, as Susan Nevelow Mart has demonstrated in a seminal article that the different online research services (Westlaw, Lexis Advance, Fastcase, Google Scholar, Ravel and Casetext) produce significantly different results when researching case law. Furthermore, a recent study of 325 federal courts of appeals decisions, revealed that only 16% of the cases cited in appellate briefs make it into the courts’ opinions. The usability and long-term preservation of digital humanities projects, such as a digital archive or other project built around digitized materials, depend on thoughtful and thorough metadata creation. The variety of expertise required to create high-quality metadata for digital humanities projects practically requires a collaborative approach. Putting the call for collaboration into practice requires tools that are accessible and functional for all collaborators. Research on tools for metadata creation has tended to focus either on tools for librarians to manage digital project metadata or on tools for independent author metadata creation (Greenberg, 2003; Crystal & Greenberg, 2005). On October 15, 2019, the Washington and Lee Law Library hosted the third bi-annual W&L Law Fall Scholarship Celebration. The event was co-sponsored by the Frances Lewis Law Center and took place in the Law Library's main reading room from 4:30 to 6:30 p.m.
On display were dozens of scholarly articles, books, and chapters authored by the W&L Law faculty and student body during 2018 and 2019, with hundreds of additional works accessible online through the Scholarly Commons institutional repository.
