An Ecological And Holistic Analysis Of The Epistemic Value Of Law Libraries, Paul D. Callister, Dana Neacsu

We examine the libraries' roles within the "epistemic foundation of society.” Our analysis is in response to the omission of Yale Law Dean Gerken of the role of libraries in her recent article about legal education's new focus and to remarks by AALS President Vicki Jackson that suggest an uncertain role for libraries. We have adapted holistic ecological media theory, as developed by Ronald Deibert, to reject a technologically deterministic view of libraries as having no future. From The Courtroom To The Boardroom: Transactional Oral Advocacy, Adam N. Eckart

Legal writing courses often teach oral advocacy skills with courtroom-based oral arguments, pitting plaintiff’s counsel against defendant’s counsel. However, oral advocacy skills are important for all lawyers – even those who never set foot in a courtroom. This article discusses how legal writing courses can develop oral advocacy skills by pairing traditional litigation-based oral argument exercises with transactional-based oral advocacy exercises and provides a sample exercise (which has received positive feedback from students) that professors can use to introduce transactional-based oral advocacy skills.

Feminism’S Transformation Of Legal Education And Unfinished Agenda, Jamie Abrams

Feminism has had a broad influence in legal education. Feminist critiques have challenged the substance of legal rules, the methods of law teaching, and the culture of legal education. Following decades of advocacy, feminist pedagogical reforms have generated new fields, new courses, new laws, new leaders, and new feminist spaces. There are many reasons to celebrate the accomplishments of our feminist pioneers and champions. Yet, COVID-19 has also exposed all the vulnerabilities and tenuousness of feminist gains too. Critical work remains for faculty, administrators, and students to carry the work forward with a vigilant purpose and determination.

When CWSL was forced to switch to online learning for the COVID-19 pandemic, we worked hard to follow best practices for online learning by attending online conferences and voraciously reading everything we could find to make the learning experience the best we could for our students. CWSL's Legal Skills program earned high praise in student evaluations for adapting so quickly given the difficult circumstances.

Deal Me In: Leveraging Pedagogy To Integrate Transactional Skills Into The First Year Legal Research And Writing Curriculum, Adam N. Eckart

When nearly fifty percent of attorneys practice transactional law, why do only seven percent of first year legal research and writing courses teach transactional skills? Despite a decade of emphasis by legal scholars on the need to teach transactional skills, most first year legal research and writing courses still focus disproportionately on litigation-based instruction. When more incoming law students want to practice transactional law than litigation, half go on to hold transactional-based jobs, transactional drafting courses are the most popular legal writing electives, and employers say graduates are unprepared for transactional practice, something needs to change. This Article explores what we coin “rock and hard place” (RHP) arguments in the law, and it aims to motivate mission-driven plaintiffs to seek out such arguments in their cases. The RHP argument structure helps plaintiffs win cases even when the court views that outcome as unfavorable.

We begin by dissecting RHP dilemmas that have long existed in the American legal system. Email has changed law practice. It is now changing the legal writing classroom. For over a decade, scholars have developed a foundation for teaching e-memos. But as e-memo pedagogy evolved, scholars diverged in their advice and their textbook samples, leaving professors and students with contradictory instruction. This Article seeks to bridge that divide and build upon the scholarly foundation with empirical evidence.

Between 2018 and 2019, over 100 practicing attorneys reviewed and ranked sample, substantive e-memos and answered questions about e-memo preferences and habits. The results of the study reveal attorneys prefer e-memos with explicit and detailed legal reasoning, not …

This chapter, part of Integrating Doctrine and Diversity: Inclusion and Equity in the Law School Classroom (Carolina Academic Press 2021), provides an overview of the U.S. Feminist Judgments Project, a collaboration of feminist scholars and lawyers who rewrite significant judicial opinions using feminist methods and reasoning. One of the primary goals of the series of Feminist Judgments books is to demonstrate that the law has a vast, but often unrealized, potential for social justice.
