As the fashion industry—including the sneaker industry housed within it—continues to go through the motions of collectively flocking out, and then collectively flocking again to the newest innovations in the world of wearables, the landscape of laws to protect and promote those innovations expands as well, mainly in the area of intellectual property law. Although copyright, trademark, and patent law can cover innovations in the fashion industry, this Note centers its analysis on trademark law. Prejudice Standards In Washington’S Appellate Courts, Andrew B. Van Winkle

When an appellate court finds an error to have occurred during a proceeding, the error is not yet subject to correction. In order to merit a remedy, the error must have been sufficiently prejudicial to the aggrieved party’s case. Drawing the line between correctable and non-correctable errors is not an easy task, for it often requires guessing at what was in the minds of jurors and trial judges. To cope with this task, courts have devised various rules and tests for deciding whether an error was likely prejudicial or not. These standards often go by names such as “harmless error,” …

Merging The Bench, Bar, And Law Schools: How A Student Scholars Program Achieves Professional Identity Through Scholarly Writing, Mentorship, And Presentation, Joan Foley, Robin Boyle, Troy Kessler

This Article describes an innovative co-curricular program, the Student Scholars Program, that provides law students with an opportunity to present their scholarly papers before the bench, bar, and law school community. The Program aids law schools in meeting accreditation standards, such as the ABA Standards 302 and 303. Standard 302 requires law schools to achieve specific learning outcomes. Standard 303(b)(3) requires law schools to provide "substantial opportunities" for students to develop a "professional identity." This program aids schools in achieving these standards. Furthermore, this program increases interaction between students and the legal profession by creating episodic mentoring opportunities. Launched in …

Closing The Feedback Gap: Reflections As Diagnostic Resource, Jaclyn Celebrezze

Providing students with helpful, actionable feedback is a perennial challenge. This presentation identifies an additional data source for instructors when drafting feedback: digital student reflections. This process has a dual benefit for both instructors and students. For instructors, digitized reflections unlock an understanding of why a student drafted a certain way, minimizing guesswork and ensuring more targeted feedback. For students, this process directs the instructor’s gaze to a concrete concern or discomfort for immediate response. While not a solution for all feedback problems, digitizing student reflections allows instructors and students to work together to close the gap.

In an essay called "Secrets of Positive Feedback,” Douglas Conant, the former CEO of Campbell Soup Company, shares a key element of the leadership style that helped him resurrect Campbell’s from financial ruin in 2001 and turn it into both a highly profitable business by the time he stepped down in 2011 and an award-winning, much more inclusive workplace: During his ten years at the helm, he wrote more than 30,000 thank-you notes to his employees and customers.

We Need To Understand How Chatgpt Can Be Used For A Contract Drafting Class And Change Our Pedagogy To Compensate, Ben Fernandez

You might think ChatGPT would not work well to assist students in a law school class on Contract Drafting. The model was not created for that purpose and it has no legal training. But you would be wrong. There are deficiencies but they can easily be compensated for. A student who knows what they are doing can use the model to do the work for a drafting class. As a result, law professors who teach Contract Drafting need to understand how to use ChatGPT, and how effective it can be as a drafting tool. And we also need to think …

The legal research course is over a century old. As a law school subject, it predates many doctrinal courses, as well as the advent of clinical legal education. It is several decades older than its sister subject, legal writing. In spite of its age and obvious importance, the place of the legal research course in the law school curriculum remains contested. While some law faculties recognize the value of legal research instruction and require a standalone legal research course in the first year, the vast majority combine it with legal writing (often over the objections of legal writing instructors and …
