A Guide To Searching Cyberspace Law Online, Jennifer L. Selby

Cyberspace law is an umbrella term that touches on and encompasses many different areas of the law, including Internet, intellectual property, cybercrime, e-commerce, and privacy, among others. Cyberspace law includes aspects of United States law, in addition to foreign, comparative, and international law.1 Today, legal researchers in cyberspace law can enhance their search capabilities with web-based resources, including primary and secondary materials. Many of the resources discussed here are available freely on the Internet. For those resources that are licensed and networked, researchers may access them only at subscribing law libraries, and not remotely.2

Following World War II, the German philosopher Martin Heidegger offered one of the most potent criticisms of technology and modern life. His nightmare is a world whose essence has been reduced to the functional equivalent of “a giant gasoline station, an energy source for modern technology and industry. This relation of man to the world [is] in principle a technical one . . . . [It is] altogether alien to former ages and histories.” For Heidegger, the problem is not technology itself, but the technical mode of thinking that has accompanied it. Students are coming to law school increasingly dependent on computers to serve their research needs. And they expect that computerized legal research will be both more efficient and more effective than book-based research. These expectations place students in conflict with traditionalists who point to the inherent limitations of computer-assisted legal research and the dangers in relying on legal research conducted entirely in electronic databases. These traditionalists favor a “books first,” if not a “books only,” approach. This paper explores the cultural conflict between the traditionalists and the “Google generation,” evaluates the dangers associated with computer-assisted legal research, and proposes a …

The role of libraries in American society is varied: libraries act as curators and repositories of American culture's recorded knowledge, as places to communicate with others, and as sources where one can gain information from books, magazines and other printed materials, as well as audio-video materials and the Internet. Courts in the United States have called libraries "the quintessential locus of the receipt of information, "'places that are "dedicated to quiet, to knowledge, and to beauty," and "a mighty resource in the free marketplace of ideas." These positive views of libraries are often in sharp contrast with views by some …

In this bench memo, the Supreme Court of the state of Marshall is asked to decide whether the actions of defendant, Marshall Manatees, evidence a theory of false light invasion of privacy as defined by the Restatement (Second) of Torts and whether defendant's actions of comparing the digital photographic images collected at the Marshall Center to their database and ultimately posting plaintiff's photo on its billboard constituted an actionable claim for misappropriation.
