A Refutation From Capitalism Toward Environmentalism’S Critics Related Environmental Problem, Riska Fara Farucha, Naupal Asnawi
International Review of Humanities Studies
From environmentalism’s perspective, there are four fundamental assumptions that make capitalism inconsistent with efforts to preserve the environment. First, unlimited growth in the capitalist system is contradicted with limited environmental conditions. Second, the basic principles of capitalism (individual freedom, self-interests, and free-market) are not compatible with efforts to preserve the environment. Third, capitalism has caused a "metabolic rift" between society and the ecosystem. Fourth, the tendency of capitalism that creates consumer society will produce massive pollution. This article is intended to refute these four environmentalism critics and also demonstrate the coherence of the theory of capitalism on environmental preservation. To …

Ipse Dixit, the podcast on legal scholarship, provides a valuable service to the legal community and particularly to the legal academy. The podcast’s hosts skillfully interview guests about their legal and law-related scholarship, helping those guests communicate their ideas clearly and concisely. In this review essay, I argue that Ipse Dixit has made a major contribution to legal scholarship by demonstrating in its interview episodes that law review articles are neither the only nor the best way of communicating scholarly ideas. This contribution should be considered “scholarship,” because one of the primary goals of scholarship is to communicate new ideas.

Poland’S Challenge To Eu Directive 2019/790: Standing Up To The Destruction Of European Freedom Of Expression, Michaela Cloutier
Dickinson Law Review (2017-Present)
In 2019, the European Parliament and Council passed Directive 2019/790. The Directive’s passage marked the end of a fouryear- long legislative attempt to impose more liability for copyright violations on Online Service Providers, an effort which was controversial from the start. Online Service Providers fear that the 2019 Directive, especially its Article 17, will completely change the structure of liability on the Internet, forcing providers to adopt expensive content filtering systems. Free speech advocates fear that ineffective filtering technology will infringe upon Internet users’ rights to express themselves, and legal scholars have pointed out the Directive’s inconsistency with prior European …

Today, companies use blockchain technology and digital assets for a variety of purposes. This Comment analyzes the digital token. If the Securities and Exchange Commission (SEC) views a digital token as a security, then the issuer of the digital token must comply with the registration and extensive disclosure requirements of federal securities laws.
To determine whether a digital asset is a security, the SEC relies on the test that the Supreme Court established in SEC v. W.J. Howey Co. Rather than enforcing a statute or agency rule, the SEC enforces securities laws by applying the Howey test on a fact-intensive …

This article examines the procedural and remedial barriers to recognizing artificial intelligence (AI) as a legal author under the Copyright Act of 1976 by shifting the focus from doctrinal authorship debates to questions of liability. While much scholarship has explored whether AI can satisfy originality and creativity requirements, the authors argue that a critical feature of authorship—susceptibility to suit for infringement—has been largely overlooked. The article analyzes civil procedure challenges that would arise if an AI were named as a defendant, including personal jurisdiction, domicile, service of process, due process protections, and venue. It further evaluates the feasibility of traditional …

Last year, before the onset of a global pandemic highlighted the critical and urgent need for technology-enabled scientific research, the World Intellectual Property Organization (WIPO) launched an inquiry into issues at the intersection of intellectual property (IP) and artificial intelligence (AI). We contributed comments to that inquiry, with a focus on the application of copyright to the use of text and data mining (TDM) technology. This article describes some of the most salient points of our submission and concludes by stressing the need for international leadership on this important topic. The state of the law in the United States is complicated by the fact that the de minimis doctrine is, and has been a muddled doctrine. Copyright law and patent law allow future authors and inventors to build upon the works of previous rights holders. In the patent world, the new work must be a non-obvious improvement on the original patent. In copyright, the key is that the secondary user cannot take a substantial portion of the prior author's copyrightable expression. There is no infringement without substantial similarity. By definition, a de minimis taking is the polar opposite of substantial …
