The Boston Legal Aid Society was founded in 1900. In the years after 1910, led by General Counsel Reginald Heber Smith, the Society assumed leadership of the fledgling movement to offer legal services to the urban poor. Under its influence the first organized attack on the legal problems of the impoverished was launched. The effort had its origins in the social and professional crises that beset turn of the century American cities and lawyers. As described in the first installment of this article, the major difficulty facing the movement during this generative era was how to balance the conflicting demands …
A Review: Unequal Justice: Lawyers And Social Change In Modern America, Lawrence Mayberry
A Review: Unequal Justice: Lawyers And Social Change In Modern America, Lawrence Mayberry
IUSTITIA
Unequal Justice is a social history of the legal profession from the emergence of The American Bar Association in the 1870's until the 1970's. Auerbach is a professional historian and not a member of the legal profession who writes history, nor is he a sociologist. But before his graduate work in history, the author entered and quickly left law school. The honesty with which he relates the experience and the competent research and analysis manifest in his work demonstrate that he writes this book from a perspective of understanding rather than of bitterness or indifference. In fact Auerbach's unique frame …

Statutes As Judgments: The Natural Law Theory Of Parliamentary Activity In Medieval England, Morris S. Arnold
Statutes As Judgments: The Natural Law Theory Of Parliamentary Activity In Medieval England, Morris S. Arnold
Articles by Maurer Faculty
The proposition that late medieval English lawgivers believed themselves to be exercising a declarative function has been so frequently put forward and so widely accepted that it is in danger of being canonized by sheer dint of repetition; and thus one who would deny the essential validity of that notion bears the virtually insuperable burden of proof commonly accorded an accused heretic. Nevertheless, it will be argued here that natural law notions are attributed to the medieval English legislator with only the slightest support from the sources, and after only the most rudimentary and uncritical analyses of the implications of …

Obscenity, The Law And Religion, Thomas A. Long
IUSTITIA
The long history of the relation between Western religion and secular law is both interesting and complex.' In what follows I shall discuss one current social issue which is illustrative of this relation, namely, the relatively recent legal-moral controversy over obscenity.

The revival of feminism is in many ways different from its earlier stage, although this may in large part be due to what the early feminists accomplished. They were more concerned with substantive legal change-property rights, child custody, divorce, suffrage, and others. In addition to filling in some of the substantive right gaps, we today are more concerned with social attitudes and the exercise of legal rights. Although modern-day feminists have advocated the passage of some reform legislation particularly, the Equal Rights Amendment, much of the focus of the movement is on social and cultural changes.

America And Reconsruction, Thomas B. Grier
America And Reconsruction, Thomas B. Grier
IUSTITIA
Reconstruction has variously been termed "repressive. . . uncivilized" and "a sordid time" as well as "a noble experiment." Reflected in those judgments of the era is the dispute over the effects of Reconstruction. To be more correct, one might say that there has been much conjecture in determining what, in fact, Reconstruction was. Questioned also has been the role of the black man during the period; much of what he did, or was responsible for, has, like Reconstruction itself, been subject to many and varied accounts and evaluations. The intent of this paper is to examine several volumes concerned …
