Situating Ai Within The History Of Technological Adaptation In Law, Karin Mika

This Article argues that the current anxiety surrounding generative artificial intelligence (AI) in the legal academy is the latest iteration of a recurring historical cycle. By examining the introduction of other technological enhancements in the law, the author demonstrates that each technological shift was initially met with skepticism regarding the potential loss of critical thinking skills. However, history shows that these tools ultimately pushed the profession away from a focus on mechanical form and toward a deeper engagement with substantive analysis and strategic advocacy. Aba Model Rule 8.4(G): National Adoption Is Long Overdue, Sara Rakowiecki

In 2016, the American Bar Association amended the Model Rules of Professional Conduct to include Rule 8.4(g) in an attempt to include a prohibition against discrimination and harassment with conduct related to the practice of law. While discrimination and harassment remain commonplace in the legal profession, many states refused to adopt Rule 8.4(g) which resulted in an unprecedented response to the ABA amendment. In this article, Sara Rakowiecki emphasizes the necessity for the legal profession to adopt and apply Rule 8.4(g) to cultivate a legal community where lawyers are consistently ethical and professional in the practice of law.

In April 2021, the ABA published a study entitled Practicing Law in the Pandemic and Moving Forward: Results and Best Practices From a Nationwide Survey of The Legal Profession. The results of this study confirmed what many women and people of color already knew – standard approaches to the workplace do not serve goals of diversity and inclusion, especially during times of great stress and financial uncertainty.

Most Americans expect that if they are arrested, they will quickly appear before a judge, learn about the charges, and have an attorney assigned to defend them. The reality is vastly different. After arrest, a person can wait in jail for days, weeks, or even months before seeing a judge or meeting an attorney. This report chronicles the resulting initial appearance crisis and highlights its devastating consequences. More importantly, it provides policymakers and advocates with actionable recommendations.

Experiences with UNM’s parental leave policy C215 have been evaluated using the ADVANCE 2018 Main Campus Faculty Climate Survey, a series of junior faculty interviews, and concerns brought to the ADVANCE leadership. Key findings are:

• Women and STEM faculty are more hesitant to use family-leave policies, and perceive greater disadvantage in using them than men and non-STEM faculty
• Sharing of information about, and implementation of, parental leave varies significantly between units
• The attitude of the department chair and senior faculty strongly influence the experience of faculty who use parental leave
• Appropriately implemented, the parental leave policy contributes to faculty recruitment …

Children and animals are treated much the same under the law. Both are seen as having limited, if any, legal rights. For children there are legal processes that can be used to determine if a minor is mature enough to be considered a legal person for life affecting decision making considerations and emancipation proceedings.
