Nextgen Bar Success: A Student-Tested, Student-Approved Method For Completing Counseling Integrated Question Sets, Kari Milligan

Legal educators nationwide need to begin teaching students a method for completing Counseling Integrated Question Sets, a novel type of question the National Conference of Bar Examiners (“NCBE”) is introducing on the NextGen bar exam. Counseling Integrated Question Sets require students to answer a series of six multiple choice or short answer questions focused on client counseling or dispute resolution, as they work through an unfolding common fact pattern that also contains rules or elicits rules students have memorized.

Whither Coursework And Nextgen Bar Exam Success?, Robert R. Kuehn

The NextGen bar exam will focus on an expanded range of essential lawyering skills and a reduced set of legal topics. Moving toward less reliance on knowledge of the black letter law concepts of past exams, it seeks to build on the successes of clinical legal education, alternative dispute resolution, and legal writing and analysis programs. With outcomes from the first NextGen exam still two years away, this commentary examines what existing research suggests about law school coursework and likely success on NextGen that might guide students and law schools in preparing for the new exam.

Scholarly Works
The National Conference of Bar Examiners (NCBE), which develops American bar examinations, recently released a proposed outline of the subjects to be tested on future examinations. NCBE's property outline omits zoning law. This article argues that the NCBE's proposal is unwise, because zoning law is more frequently litigated than many subjects included in the NCBE outline.

Nothing to see here. Season in and season out, bar examiners, experts, supreme courts, and bar associations seem nonplussed, trapped by what they see as the facts, namely, that the bar exam has no possible weaknesses, at least when it comes to alternative licensure mechanisms, that the bar exam is not to blame for disparate racial impacts that spring from administration of this ritualistic process, and that there are no viable alternatives in the harsh cold world of determining minimal competency for the noble purpose of protecting the public from legal harms. Talking about grades and grading in law school can feel as taboo, if not more, than talking about sex. Among law faculty, there is often no training and no discussions about how to grade other than being asked to moderate final grades to meet a curve. Students often seek information from each other or online sources where numerous blogs provide them with advice on how to talk to professors about grades, how not to disclose grades to others, and other advice about dealing with grades.
