The Unjust Selection Of Justice Professionals: Balancing Fairness For Police Officer Applicants And The Potential Citizens They Will Serve, Robert W. Boyle

This paper examines the effects on the community when its police officers are held to different physical standards based upon their sex. Through a Platonic analysis of the modern day "guardians of the city," it can be seen that the community is deprived of the strongest and best police force when the department compensates individuals based upon a "weakness" that thier class of applicants possesses. This process proves to be unfair to both the applicants and to the citizens they may subsequently serve.

The purpose of this study was to analyze local law enforcement's counter-terrorism capabilities as it relates to the varying size of United States local law enforcement agencies. Data for the study came from a study entitled "Impact of Terrorism on State and Local Law Enforcement Agencies and Criminal Justice Systems in the United States, 2004". Statistical analysis revealed that there are large disparities in the allocation of resources to intelligence gathering, analyzing, and sharing between smaller local law enforcement agencies and their larger counterparts. Racial Fairness In The Criminal Justice System: The Role Of The Prosecutor, Angela J. Davis

In this article, Davis analyzes discusses efforts to involve prosecutors in the elimination of racial disparities in the criminal justice system. Part II explains how prosecutors unintentionally contribute to disparities through the arbitrary, unsystematic exercise of discretion. Part III argues that the U.S. Supreme Court has failed to provide an effective legal remedy for victims of race-based selective prosecution. Finally, in Part IV, Davis endorses the use of racial impact studies and task forces and discusses a model reform effort spearheaded by the Vera Institute of Justice.

The questions of if, when, and how local police can enforce federal immigration laws go to the heart of the legal hunt for the chimera that is contemporary American immigration law.1 In the opening years of this century, the estimated illegal alien population in the United States has reached historic levels. Reinventing Structural Reform Litigation: Deputizing Private Citizens In The Enforcement Of Civil Rights, Myriam E. Gilles

The aim of this Article is to explore the possibility of constructing a model that harnesses the power of private citizens to reform unconstitutional practices, particularly in the critical area of police-related rights violations. I seek here to reintegrate private citizens into the enforcement of public laws; to tap the private experiential and financial resources that were a necessary condition of the great structural reform efforts of the civil rights movement of the 1950s and 1960s.
The vehicle by which I propose to accomplish these ends is a simple, yet novel, amendment to 42 U.S.C. § 14141, the statute which …

The question of the "purpose" of the state has been a permanent and fundamental problem of all theories of the state ever since Aristotle opened his Politics with the theory of the purpose of the state and placed this sentence at its head: pasa koinonia agathou tivos heneka sunesteken. Pre-Academy Placement In The Washington State Patrol: Factors Associated With Academy And Job Performance, Richard Franklin Hamack

Washington State Patrol Trooper Cadets serve in a number of positions, a number of locations across the state and for varying lengths of time before they are selected to attend the academy. The purpose of the present research was to determine whether these factors were related to subsequent academy performance and job performance.
To that end, 255 cadets hired between 1979 and 1985 were studied. The results indicated that only pre-academy assignment duration was significantly correlated with academy completion and academy performance. Implications for further research and departmental policy are discussed.
