The American Law Institute's new Restatement of the U.S. Law of International Commercial Arbitration is only barely underway, and the reporters began with a chapter, namely the recognition and enforcement of awards, that should represent for them a comfort zone of sorts within the overall project. Yet, already a number of difficult, and to some extent unexpectedly difficult, questions have arisen. Some of the difficulties stem from the very nature of an ALI Restatement project. Beyond Discretion: Prosecution, The Logic Of Sovereignty, And The Limits Of Law, Conor Clarke, Austin Sarat

Today it is widely recognized in both academic literature and the main-stream media that prosecutors have substantial discretion. Yet prosecutorial decisions involve, in our view, something more than a straightforward exercise of discretion. In this article we move from the language of discretion to that of sovereignty to describe prosecutorial power. In so doing we want to move from the language of administration to the language of power. Focusing on the decision not to prosecute, we argue that prosecutorial decisions participate in, and exemplify, the logic of sovereignty and its complex relationship to legality. Operation Street Sweeper (OSS) was a multi-level, interagency collaboration with multiple purposes. According to OSS documents, Operation Street Sweeper goals included the following: (1) to reduce gang-related criminal and violent activity in Nampa and Caldwell, Idaho through aggressive, proactive, and coordinated street enforcement between the Bureau of Alcohol, Tobacco and Firearms (ATF) and local law enforcement; (2) to deter criminal activity through high profile enforcement activity; (3) to develop and/or increase the number of positive community contacts; (4) to show the community and gang members that law enforcement is serious about reducing gang and violent crime in the area; and …

The purpose of this thesis was to examine the effects of collective efficacy and dissatisfaction with law enforcement on neighborhood crime rates. A data set was obtained from the Inter-University Consortium for Political and Social Research titled, Project on Human Development in Chicago Neighborhoods: Community Survey 1994-1995 (PHDCN). This is one of the only studies which ask specific questions concerning collective efficacy and dissatisfaction with law enforcement, accompanied with a large, diverse sample. The City of Las Vegas operates a municipal detention facility, primarily housing offenders who have committed misdemeanor crimes within the 130 square miles of the Las Vegas City limits. Similar to many jurisdictions, within the State of Nevada, but also across the Country, the offender population is on the rise. The City’s inmate population has grown steadily at a rate of 10%, annually, for five years. This trend, when calculated as a future projection, suggests the City must be prepared for the misdemeanant population to swell from its current daily average of 1144 to more than 3000 inmates by the …

Development And Confirmatory Factor Analysis Of The Community Norms Of Child Neglect Scale, Rebecca Goodvin, David R. Johnson, Sam A. Hardy, Michelle Graef, Jeff M. Chambers

This article describes the development of the Community Norms of Child Neglect Scale (CNCNS), a new measure of perceptions of child neglect, for use in community samples. The CNCNS differentiates among four subtypes of neglect (failure to provide for basic needs, lack of supervision, emotional neglect, and educational neglect). Scenarios ranging in seriousness for each subtype were presented to a large community sample (N = 3,809). Confirmatory factor analyses indicated that a four-factor model provided a better fit to the data than did a model specifying only one overall neglect factor, suggesting this sample distinguished among the four subtypes of …

It is estimated that about one quarter of all HIV-infected individuals in the United States are released from a correctional facility each year. To better understand the needs of inmates with HIV exiting the prison system, a partnership with the Nevada State Health Division (NSHD), the Nevada Department of Corrections (DOC), and the University of Nevada, Reno School of Public Health was formed to examine this population using information contained in existing databases. An analysis of DOC data matched with the data from the HIV/AIDS Reporting System (HARS) maintained by the NSHD identified 2,802 HIV-negative inmates (2,451 males and 350 …

A common argument against privatization is that private providers, motivated by self-interest, will advocate changes in substantive policy. In this Article, I evaluate this argument, using, as a case study, the argument against prison privatization based on the possibility that the private prison industry will distort the criminal law by advocating incarceration.
This “political influence” argument applies at least as well to public provision: Government agencies, too, lobby for changes in substantive law. In the prison industry, for instance, it is unclear whether private firms advocate incarceration to any significant extent, but public guard unions are known to do so …

Police departments strive to hire good officers. However, there is difficulty in defining what constitutes a good police officer. The literature is rife in defining what constitutes a good police officer and characteristics indicative of a good officer. Past research suggests that characteristics of a good police officer may be more than the characteristic itself and that officers' may form their perception of what characteristics good officers harbor based on socialization, the police subculture, and the official police organization.

Reform In Lieu Of Change: Tastes Great, Less Filling, Jonathan G.S. Koppell

In this response to Light, Koppell argues that the increasing frequency of reform may reflect Congress's inability to make significant changes to the substance of entrenched government programs. Moreover, he observes that the more profound evolution in government has been the movement toward the market-based provision of services, which has created a demand for new competencies in the public sector.

This paper discusses the modern problem of dealing with money laundering. Illicit occupations inherently create illicit incomes that must be given the appearance of legitimately earned income. The more government criminalizes activities of its citizens, the greater the need for laundering money.

In practice, the problem of law enforcement is half a matter of what the government does to catch violators and half a matter of what violators do to avoid getting caught. In the theory of law enforcement, however, although the state’s efforts at "detection" play a decisive role, offenders’ efforts at "detection avoidance" are largely ignored. Always problematic, this imbalance has become critical in recent years as episodes of corporate misconduct spur new interest in punishing process crimes like obstruction of justice and perjury. This paper presents data concerning the effect uniformed police officers have on attitudes towards the police and fear of crime within the high school setting. Two identical surveys were administered to 522 high school students at two periods during a school year. The primary purpose was to determine whether placing uniformed police officers, called School Resource Officers, in high schools would improve attitudes towards the police and reduce the fear of crime. Although opinions towards the police were positively affected and the fear of crime was reduced, neither was affected significantly. The primary implication drawn from this research is that …

The purpose of this research project is to examine three competing models of citizen satisfaction with the police: 1) citizen characteristics, 2) citizen experience with the police, and 3) citizen quality of life issues. Data were taken from Criminal Victimization and Perceptions of Community Safety in 12 Cities, 1998. The relationship between citizen satisfaction and the three models were tested by examining different types of contact between police and citizens, race, age, gender, and quality of life, which was measured by satisfaction with neighborhood and satisfaction with city. The current study examines the effects of type of assault and victim gender on police response. Victim accounts of domestic and nondomestic assaults in the San Diego region were examined. This study found that domestic assaults were significantly less likely to result in arrest than nondomestic assaults. Female victims of domestic assaults were more likely to receive police referrals to outside agencies. Assaults with victim injury were more likely to result in arrest for domestic assaults, and within the sample as a whole. The gender of the victim had no effect on arrest.

The use of firearms by police officers is a subject that has not received much attention in past research. It is a rare occurrence for police officers to have fire their weapon in the line duty, which has also made this area of law enforcement difficult to study. In addition, little data is kept on the extent of firearm use by police officers. Several theories have been proposed to explain firearm use by police officers as well as how officers decide to use their weapon or not.
