Federal employment discrimination statutes condition a claimant’s right to sue on timely receipt of a “right-to-sue” notice from the United States Equal Employment Opportunity Commission (EEOC). Courts have historically treated certified mail slips as sufficient to trigger a claimant’s ninety-day filing window, regardless of when the claimant opened or retrieved the letter. In the digital era, the EEOC increasingly issues notices through email and its online Public Portal, raising questions about when electronic notice constitutes “receipt.”

Using Lonergan’S Method To Instruct For The Scholar: St. Mary’S Law Review On Race And Social Justice, Mike Martinez Jr
San Jose - Lonergan Chair in Catholic Philosophy
The Scholar began in the 2000s to bring light to the social justice issues of the day: Hopwood, Proposition 187 in California, Amendment 2 in Colorado, and the aggressive assault on civil rights laws, immigrants’ rights, and bilingual education. The origins of this publication began as a grassroots effort of six law students working to make a difference and contribute to the legal conversation by advocating for traditionally marginalized groups. The vision of the founding editors provided a voice for ethnic minorities, LGBTQ+, immigrants, racial minorities, women, and other disenfranchised groups often silenced in our legal discourse. Legal clients in the United States are increasingly multilingual and multicultural. More than 71 million people living in the United States communicate in a language other than English. Consequently, the lawyer’s duty of shared understanding is taking on new meaning. With the advent of ABA Ethics Opinion 500, cross-cultural communication skills are a lawyer’s ethical duty and a law school’s mandate. Additionally, ABA Standard 303(c) and the potential of increased experiential learning credit requirements make clear that immediate curricular changes are needed. To prepare for the modern practice of law, tomorrow’s lawyers need to develop cross-cultural skills while in law …

. Of the fifty-six blackletter provisions in the Model Rules of Professional Conduct, the rule about pro bono is the only one that tells lawyers they “should”—rather than must, must not, or may—take a particular action. This verb, which in effect says: “You deserve praise if you do it but hey, no pressure,” embodies the partial perspective that dominates pro bono—partial in the sense of both incomplete and biased. Valorizing pro bono while imposing no consequences on people who fail to perform it indulges and flatters what this Article calls pro bono’s supply side. Bar leaders, rule writers led by …

Code-Switching is a linguistic phenomenon that can occur between different languages, cultures, or dialects. This study focuses on code-switching within the legal field, specifically through an analysis of legal blog websites. Through searching the terms, “code-switching” and “foreign language”, this study will compare legal blog websites in their coverage of the phenomenon. The various websites’ definitions of code-switching, how the topic is written with context, and what implications are suggested in the writing will be considered when crafting a comparative analysis. Sexual violence remains a contentious public safety and legal challenge, which has become further complicated by the tension between supporting victim-survivors and safeguarding the falsely accused. False accusations, though still well below the numbers of rightly accused, are experiencing a rise in popularity given recent (past ten years) political climates. This thesis examines how communication theory, neuroscience, and law intersect in molding perceptions of truth, culpability, and justice in sexual violence cases; while also examining the intersectionality of those fields in addressing the candor of allegations, the rate of recidivism, and quality of public health and safety.
