The Language Of Involuntary Mental Hospitalization: A Study In Sound And Fury, Steven H. Levinson Jan 1970

The Language Of Involuntary Mental Hospitalization: A Study In Sound And Fury, Steven H. Levinson

University of Michigan Journal of Law Reform

Involuntary civil commitment is the business of hospitalizing and treating, without their consent, persons whom a court, with the aid of professional diagnosticians, determines to be psychologically disturbed or mentally ill. The purpose of the present study will be to demonstrate that the medical diagnoses of mental illness which justify involuntary civil commitment are achieved on the basis of at least unreliable and at worst invalid sets of diagnostic categories and assessments. For the purpose of determining the reliability of these diagnostic findings, the author selected a representative sample of the involuntary mental hospitalization proceedings of the Wayne County Probate …

Law And Anarchy, Sidney Hook

University of Richmond Law Review

I wish to consider certain views and attitudes about law and government that seem widely held today, that encourage contempt for law and at least indirectly bear on current political behavior.

Challenges To Humanitarian Legal Approaches For Eliminating The Hazards Of Drunk Alcoholic Drivers, Joseph W. Little Jan 1970

Challenges To Humanitarian Legal Approaches For Eliminating The Hazards Of Drunk Alcoholic Drivers, Joseph W. Little

Georgia Law Review

Two epidemics ravage this country. One is the plague of highway crashes that claims the lives of three scores of thousands of Americans each year. The other is the scourge of alcoholism that brings not only personal degradation to the lives of six million sufferers but also despair, hardship, suffering and death to countless nonalcoholic persons. As even a cursory review of current legal literature will reveal, research findings demonstrate beyond any doubt that these two epidemics are not mutually independent. Although one is rarely able to place definite causal blame upon any single factor in any instance, statistical evidence …

Pedophilia, Exhibitionism, And Voyeurism: Legal Problems In The Deviant Society, E. C. B., Jr. Jan 1969

Pedophilia, Exhibitionism, And Voyeurism: Legal Problems In The Deviant Society, E. C. B., Jr.

Georgia Law Review

Statutes concerning sexual offenses have long been part of the criminal law. Deviants, psychopaths, sodopaths, and perverts are some of the terms applied to offenders. These terms are dependent upon and conditioned by cultural norms,' which describe certain forms of behavior as deviant, and by legal norms which outline the nature of each offense.2 Because of the myriad sexual acts considered unlawful in the United States,3 Dr. Kinsey has concluded that ninety-five percent of the American male population are technically sex criminals.4 It is indeed ironic that sex laws, which are violated by such a large majority of the population, …

Disposition Of The Irresponsible: Protection Following Commitment, Travis H. Lewin Feb 1968

Disposition Of The Irresponsible: Protection Following Commitment, Travis H. Lewin

Michigan Law Review

Each year more of our fellow citizens are involuntarily committed to a mental institution of one sort or another than are incarcerated for the commission of a crime. To those committed, the walls and barred windows of the hospital, as well as the treatment and mode of living, are probably not significantly different from those of a prison. This is particularly the case with those confined for treatment by court order or by some special statutory procedure following acquittal of a crime on grounds of insanity. Yet these mentally ill, even after perpetrating what would otherwise have been a criminal …

Psychiatrist In Workmen's Compensation Field, Donald W. Loria Jan 1968

Psychiatrist In Workmen's Compensation Field, Donald W. Loria

Cleveland State Law Review

At one time, if a physician could find no objective evidence of disability, an employee usually lost his workmen's compensation case. If the x-ray and the electroencephalogram were negative, if no muscle spasm were present, if the diminished sensation to pinprick followed no anatomical pattern-if the doctors could find nothing in the examination to substantiate the employee's complaints of pain-the decision invariably found the employee was malingering. Compensation was denied. Toward the middle of this century, psychiatry began to offer some explanations.

Custody Disputes And The Proposed Model Act, Carroll Leavell Jan 1968

Custody Disputes And The Proposed Model Act, Carroll Leavell

Georgia Law Review

In the Adventures of Huckleberry Finn, Mark Twain describes the situation of Huck who had recently come into money, when his "drunken vagrant" father came home to claim his "rights"; Roscoe Pound used this satire to remark upon "the extent to which the older law neglected the individual interests of children... ." That this neglect continues is evident to even the most casual reader of custody cases.

Recent publicity given an Iowa case, Painter v. Bannister, has focused the attention of the public on the troubled area of custody law. A storm of protest was aroused when an Iowa judge …

Chronic Alcoholic Court Offenders: An Alternative To The Drunk Tank, Jack H. Watson, Jr Jan 1968

Chronic Alcoholic Court Offenders: An Alternative To The Drunk Tank, Jack H. Watson, Jr

Georgia Law Review

T HE social problem of alcoholism may be divided into two categories: (1) that of the "visible" alcoholic or "chronic alcoholic court offender" whose illness is manifested hundreds of thousands of times per year either on city streets, or in countless city and county stockades acoss the country; and (2) that of the "invisible" alcoholic whose illness is just as serious, but whose social and economic position permits him to suffer through years of alcoholism without being arrested or taken before a magistrate for being drunk in public. It is estimated that over 6,500,000 persons in the United States are …

Compulsory Community Care For The Mentally Ill, Beatrice K. Bleicher Jan 1967

Compulsory Community Care For The Mentally Ill, Beatrice K. Bleicher

Cleveland State Law Review

At the present time, the benefits of community care are limited to voluntary patients, but they should be extended to involuntary patients as well. This paper discusses the need for compulsory community care and the steps taken to meet this need in a few states and in Britain. Finally, it proposes legislation which could cope with the problems of providing community care for the civilly committed.
