Hear Today, God Tomorrow?: To Be In But Not Of The Law With Moses, And Milner Ball, Aviam Soifer

It is increasingly clear, Milner once wrote, that "the external world keeps reflecting back what we bring to it." 5 He extends his emphasis on reciprocity between observer and observed from nature and language to the realm of faith. Those who seek to be observant only of settled rules or texts have missed the crucial roles of context, reciprocity, and change. In the Hebrew Bible, for example, Milner argues that Moses hears and speaks as "counsel for a situation" as someone whose word "does not return empty."6 Indeed, Moses is able to be "mouth for the people exactly because he …

Milner Ball would be the last person to claim to have constructed a system. After all, he writes in the essay form, one that is "tentative, reflective, suggestive, contradictory, and incomplete."' It is a style that suggests there is more afoot than any science or philosophy is likely to conceive and that much of what is most important has to be shown, not stated. This article examines the main arguments used for denying moral rights to nonhuman animals, the rights to life and bodily integrity in particular. Because these arguments are deficient, animals should not be denied legal rights on the basis of their presumed moral inferiority to humans.

Law And Judicial Duty, Philip A. Hamburger

Two hundred years ago, in Marbury v. Madison, Chief Justice Marshall delivered an opinion that has come to dominate modern discussions of constitutional law. Faced with a conflict between an act of Congress and the U.S. Constitution, he explained what today is known as "judicial review." Marshall described judicial review in terms of a particular type of "superior law" and a particular type of "judicial duty." Rather than speak generally about the hierarchy within law, he focused on "written constitutions."

Review Of The Dark Side Of The Left: Illiberal Egalitarianism In America, Donald J. Herzog

In this elegantly written, provocative, and sometimes just plain provoking book, punctuated by bits of anguish and rather more pique, Richard Ellis worries that the American Left has been so passionate about equality that it has run roughshod over liberty. So put, the thesis is not exactly news. It has been the recurrent lament of conservative indictments- Tocqueville's is the canonical statement, but he has plenty of precursors and followers. And it has its scholarly variations, too, such as Arthur Lipow, Authoritarian Socialism in America: Edward Bellamy and the Nationalist Movement (1982). No profound surprises are on offer here.
