Right Wing Justice: The Conservative Campaign To Take Over The Courts, Herman Schwartz
Right Wing Justice: The Conservative Campaign To Take Over The Courts, Herman Schwartz
Books
Right Wing Justice raises the alarm about the creeping conservative campaign to "pack" America's courts with judges more identified with their ideological affiliation than their skill or regard for the Constitution. The consequence is that the rule of law is taking a terrific beating from the Supreme Court. Who can forget the debacle of Election 2000? But the consequences of the campaign go far deeper than that, impinging on the daily lives of ordinary Americans who are at the receiving end of attempts to overturn or erode Supreme Court rulings on abortion, school prayer, civil rights, criminal justice, and economic …

A Government Of Laws And Also Of Men: Judge William K. Thomas, R. Lawrence Dessem
Faculty Publications
Judge William K. Thomas served for more than forty years as a common pleas judge and as a judge for the United States District Court for the Northern District of Ohio. During his service on the state and federal bench, Judge Thomas epitomized the qualities of fairness, integrity, justice, and compassion that we expect in our judiciary. This article highlights some of the qualities that made Judge Thomas a truly great judge, as well as some of the highlights of his judicial career. It is written as a memorial tribute by one of his former law clerks.

My task, as I understand it, is to make some observations about where complex litigation might head in the future - and some suggestions about how we might do our work today to make that future better. As I write this paper, I realize, of course, that this task is an impossible one. It is not impossible to imagine any of a number of possible futures for complex litigation; indeed, I spend a great deal of time imagining multiple possible futures. Since I am writing a month in advance of the conference, however, it is impossible to connect the ideas …

Is This Appropriate?, Thomas L. Shaffer, Julia B. Meister
Is This Appropriate?, Thomas L. Shaffer, Julia B. Meister
Journal Articles
The word "appropriate" is so wildly overused in American culture that, as with other vacuous words and phrases, a person learns to read right through it. "Appropriate" is verbal tofu. This Essay pauses instead of reading through, particularly to notice the instances in which "appropriate" and its negative counterpart are used to give the appearance of a moral or legal judgment.
"Appropriate," chosen to express a legal judgment, is not only vacuous; it is also irresponsible. It catches the legislator, judge, or administrator in the act of passing the buck, as the President did when he ordered the Justice Department …

William J. Harbison, Ward Dewitt, Jr.
Vanderbilt Law Review
Those close to him knew Bill Harbison for much more than the great legal scholar that he was. For almost twenty years I had the good fortune to practice law with him and was privileged to be his friend for over forty years. He was, as everyone knows, an outstanding lawyer and judge, but perhaps many do not know the non-legal side of Bill Harbison. In no particular order, Bill was a churchman, a sports enthusiast, a gardener, a historian, a fisherman, a lover of literature, and above all a devoted family man. For many years he was active at …
Judicial Bias, Donald C. Nugent
Judicial Bias, Donald C. Nugent
Cleveland State Law Review
This article examines how bias and prejudice may impact the decision making process of our judiciary. It begins in Part II from the premise that all judges, as a part of basic human functioning, bring to each decision a package of personal biases and beliefs that may unconsciously and unintentionally affect the decision making process. To the extent that we, as judges, recognize the potential for bias to enter into our deliberations, we combat the potential harm and unfairness that bias can produce if unchecked. Moreover, attorneys and other participants in the justice system should also be conscious of the …
