Indigenous Māori Defend Digital Sovereignty Over Big Tech’S Free Trade Rules, Jane Kelsey
Indigenous Māori Defend Digital Sovereignty Over Big Tech’S Free Trade Rules, Jane Kelsey
Indian Journal of Law and Technology
In 2016, Indigenous Māori in Aotearoa New Zealand challenged the Trans-Pacific Partnership Agreement (‘TPPA’) for breaching the colonial government (Crown) obligations to them under the 1840 Tiriti o Waitangi. This was lodged before a Tribunal particularly established to inquire into such breaches. In 2021, the Tribunal upheld that claim, finding that the TPPA e-commerce provisions failed to protect Māori identity and Indigenous knowledge. Since then, the Crown and Māori have sought means to reconcile these competing paradigms within the unequal power relations of a colonial government and Indigenous Peoples – denied the sovereignty affirmed to them in 1840. This case …
The Role Of Ai In Judicial Translation: Ensuring Access To Justice In Vernacular Languages, With Special Reference To Marathi, Bhushan Raut
The Role Of Ai In Judicial Translation: Ensuring Access To Justice In Vernacular Languages, With Special Reference To Marathi, Bhushan Raut
Indian Journal of Law and Technology
This paper examines the role of artificial intelligence in judicial translation to enhance access to justice in India’s multilingual legal system, with a specific focus on Marathi. It situates judicial translation within the constitutional framework and Rule of Law theory, arguing that linguistic accessibility is essential to legal agency and fairness. Through doctrinal, empirical, and comparative analysis, the paper evaluates initiatives such as SUVAS, highlights gaps in vernacular availability of landmark judgements, and identifies challenges relating to accuracy, accountability, and legal semantics. It proposes a hybrid AI–human model and policy reforms to ensure reliable, scalable, and inclusive translation practices in …
The Illusory Normativity Of Rights-Based Ai Regulation, Yiyang Mei, Matthew Sag
The Illusory Normativity Of Rights-Based Ai Regulation, Yiyang Mei, Matthew Sag
Indian Journal of Law and Technology
Whether and how to regulate AI is now a central question of governance. Across academic, policy, and international legal circles, the European Union is widely treated as the normative leader in this space. Its regulatory framework, anchored in the General Data Protection Regulation, the Digital Services and Markets Acts, and the AI Act, is often portrayed as a principled model grounded in fundamental rights. This Article challenges that assumption. We argue that the rights-based narrative surrounding EU AI regulation mischaracterises the logic of its institutional design. While rights language pervades EU legal instruments, its function is managerial, not foundational. These …

Les Outils Numériques : Instruments D’Inclusion Ou D’Exclusion Fiscale ?, Karim Daher
Proche-Orient, Études juridiques
Over the past few decades, with the rapid technological advancements, multinational enterprises (MNEs) and notably the internet giants have acquired a global dimension and such power which allowed them free and dominant penetration in developing countries’ markets such as Lebanon. This unrestricted penetration was facilitated by the absence of any specific local or international legal framework as well as smart tailored tax optimization enabling them to compete with local businesses and deprive national economies of significant resources. This situation has contributed at the same time to the development of the parallel or informal economy and led to a proliferation of …

Addictive By Design: Can States Regulate Social Media Algorithms In The Face Of Free Speech Challenges?, Niamh Kathleen Keane
University of Miami Business Law Review
The foe we did not know, the stranger that stole the show. Social media once presented itself as a friendly way to connect with loved ones through shared pictures and catchy captions. Yet, it has since shown its true colors; intentionally addicting its users—for its own financial benefit—and showing no remorse doing so.
Entranced, users set off on a digital journey, veering down paths they never imagined . . . Today, children as young as eight years old are exposed to extremely harmful content such as medically unsupported dieting techniques, substance abuse, and dangerous, life-threatening social media “trends,” all of …
Crossed Wires: How Current Federal Laws And Regulations Are Inadequate At Protecting Consumers From Sophisticated Wire Fraud Schemes, Emily Brafman
Crossed Wires: How Current Federal Laws And Regulations Are Inadequate At Protecting Consumers From Sophisticated Wire Fraud Schemes, Emily Brafman
University of Miami Business Law Review
The shift to digital banking has redefined the financial services industry, allowing consumers to conduct everyday transactions, such as wire transfers, at the touch of a button. However, this convenience comes at a steep price: as digital banking becomes the norm, consumers are increasingly exploited by sophisticated cybercriminals, enabled by a legal system that is ill-equipped to handle modern phishing and wire fraud schemes, ultimately draining consumer accounts. Unfortunately, existing protective measures, such as the Electronic Funds Transfer Act (EFTA) and the Uniform Commercial Code (UCC), have proven to be outdated and inadequate to address the unique risks posed by …
Which Place Governs A Placeless Place: Predicting Jurisdiction In The Metaverse, Morrease Leftwich
Which Place Governs A Placeless Place: Predicting Jurisdiction In The Metaverse, Morrease Leftwich
University of Miami Business Law Review
Oliver Wendell Holmes’s famous characterization of legal study as “prediction” takes on renewed significance as courts confront novel jurisdictional questions in blockchain cases, particularly as technological innovation accelerates and transforms the digital landscape. Among these developments is the metaverse, which combines blockchain financial technology with early visions of the internet as a distinct realm for social interaction.
Concrete problems already emerging in these immersive environments underscore the stakes: Platform‑engineered anonymity and scale make user‑to‑user harms effectively unpoliceable, what recent work calls the “veil of scale,” frustrating redress even when laws apply. Amid this difficulty in identifying bad actors, scholars have …
Regulating Data Monetization, Peter Ormerod
Regulating Data Monetization, Peter Ormerod
Texas A&M Law Review
Companies today generate hundreds of billions of dollars each year by collecting massive amounts of information about human activity and wringing predictive insights from it. The scale of these influence activities is stunning: your driving habits dictate your car insurance rates, buying the wrong thing will increase your borrowing costs, and the information ecosystem you inhabit is finely tuned for keeping your attention available to the highest bidder.
States have recently enacted new consumer privacy laws that confer on individuals a series of generally applicable rights over their personal information. But this approach has proven ineffective at disciplining firms’ data …

Combatting Ai-Generated Child Sexual Exploitation And Abuse Material: An Analysis Of India’S Techno-Legal Response, Dhruv Garg, Dedipyaman Shukla
Indian Journal of Law and Technology
The emergence of generative artificial intelligence (“AI”) presents a significant threat to child safety online, enabling the rapid creation and dissemination of child sexual exploitation and abuse material (“CSEAM”) at an unprecedented scale. This paper examines legal, institutional, and technical responses to AI-generated CSEAM in the Indian context, with a particular focus on the role of digital intermediaries, law enforcement coordination through the Sahyog Portal, and judicial interpretation under Indian law. Drawing on this analysis of key stakeholders, the paper argues for the orientation of India’s CSEAM framework towards proactive detection, and better integration between intermediaries and law enforcement. The …
The Expanding Digital Border: Ai, Surveillance, And The Fight For Justice, James Chesser
The Expanding Digital Border: Ai, Surveillance, And The Fight For Justice, James Chesser
Immigration and Human Rights Law Review
As artificial intelligence transforms the mechanisms of immigration control, the modern border has become a digital filter—one governed less by geography and more by code. This Article examines the legal, technical, and ethical implications of AI-driven systems now central to global border enforcement, including biometric surveillance, algorithmic risk scoring, and predictive profiling. It explores how states use these technologies not only to manage irregular migration, but to compete for global talent—constructing migration regimes that reward capital and compliance while eroding transparency, due process, and equality.
Through an international and comparative lens, the piece highlights the expansion of algorithmic decision-making across …
