Three employees of Mphasis, a business process outsourcing ("BPO") firm, which runs call center services for Citibank's U.S. customers in Bangalore, India, were arrested for allegedly siphoning $350,000 from the accounts of Citibank's U.S. customers. These employees used their positions, which provided them access to Citibank customers, to induce four customers into giving out the personal identification numbers to their accounts, allowing the employees to illegally siphon funds out of those accounts. Outsourcing is a growing trend among budgetconscious U.S. companies and institutions. Information being outsourced includes personal data and confidential proprietary information. For example, Unisys Corporation, a company that …

Abstract: Bloggers often work collaboratively with other bloggers, a phenomenon I call "co-blogging. " The decision to co-blog may seem casual, but it can have significant and unexpected legal consequences forthe co-bloggers. This essay looks at some of these consequences under partnership law, employment law, and copyright law and explains how each of these legal doctrines can lead to counterintuitive results. The essay then discusses some recommendations to mitigate the harshness of these results.

INTRODUCTION

This article considers the tension between free speech rights and private property/contract rights. Neither free speech rights nor private property and contract rights are absolute. Where they intersect in the physical world, confusing legal doctrines usually emerge, such as the U.S. Supreme Court cases addressing private speech at privately owned company towns and shopping centers. Though a bright-line rule has emerged-the First Amendment pertains only to stateactors-the rule provides little prospective guidance because private actors can be characterized as state actors in some circumstances.

In the online world, the speech/rights dichotomy also raises complex issues. Online private actors routinely …

Congress responded with a suite of new protections, including restrictions against circumvention, longer copyright terms, increased statutory damages, and criminalization of willful non-commercial infringement.

This Article examines the latter of those changes, effectuated through the No Electronic Theft Act (the "Act" or the "NET Act"). The Act represents a significant change to copyright law be cause it subtly shifts the paradigm underlying criminal copyright infringement.

Part I of this Article discusses the Act's development, from the …
