Two declarations are the foundation of modern international environmental law and policy: the Stockholm Declaration on the Human Environment and the Rio Declaration on the Environment and Development. Both of these declarations include well-established principles of international environmental law and policy such as state responsibility, territorial sovereignty, the necessity of ecosystem protection, and the importance of international cooperation. In addition, they both embrace revolutionary ideas. For example, the Stockholm Declaration held out the possibility of a human right to a healthy environment and suggested the need to integrate economic development and social development with environmental protection, which is the seed …

This article calls for a fundamental reorientation of international environmental law to bridge the North-South divide and respond to the ecological crises of the Anthropocene. Such a reconceptualization of international environmental law must be normatively grounded in respect for nature and in the quest for environmental justice within, as well as between, countries.

International environmental law must directly challenge the relentless drive toward economic expansion and unbridled exploitation of people and nature rather than merely attempt to mitigate its excesses. Climate change, a phenomenon caused by global warming, has impacted just about every part of the earth. As polar ice caps continue to melt, people across the world are experiencing record-breaking heat waves and warmer winters. These erratic weather patterns are just one of the many impacts of climate change. Human trafficking has become an issue for global concern. Here in the United States, the Federal government and all fifty states are taking steps to combat the pervasive problem. This study looks at the anti-human trafficking statutes of all fifty states and compares them with each other to see how each state stacks up against the other. Nebraska was the focus of the study as the unicameral has recently been enacting changes to the state’s laws against human trafficking. International adoption has been gaining popularity since the end of the twentieth century (Selman, 2002). Throughout this increase in international adoptions, the focus has drifted away from its original goal of providing homes that are in the best interest of the children (Graff, 2008). It has become more common for international adoption agencies to conduct international adoptions as a profitable business strategy, as international adoptive parents pay an average of $40,000 for a child (MGLSD, 2012; Graff, 2008). The forcible transfer of indigenous children in North America and Australia are part of a global phenomenon that consisted of the kidnapping, trafficking, removal, and identity changes of children of particular groups.

Article II(e) of the United Nation Convention on the Prevention and Punishment of Genocide prohibits the forcible transfer of children of a group to another group (FTC). The FTC echoes domestic and international legal norms and policies for the protection of children since early twentieth century. Transnational Class Actions In The Shadow Of Preclusion, Zachary D. Clopton

The American class action is a procedural tool that advances substantive law values such as deterrence, compensation, and fairness. Opt-out class actions in particular achieve these goals by aggregating claims not only of active participants but also passive plaintiffs. Full faith and credit then extends the preclusive effect of class judgments to other U.S. courts. But there is no international full faith and credit obligation, and many foreign courts will not treat U.S. class judgments as binding on passive plaintiffs. Colonialism And Cold Genocide: The Case Of West Papua, Kjell Anderson

Genocide Studies and Prevention: An International Journal

Conventional understandings of genocide are rooted in the ‘Holocaust model’: intense mass killing directed at the immediate destruction of the group. Yet, such conceptions do not encompass cases of so-called “slow-motion” genocide, where the destruction of the group may occur over generations. The destruction of indigenous groups often follows such a pattern. This article examines the case of West Papua with a view to developing a new analytical model distinguishing high-intensity “hot” genocides, motivated by hate and the victims’ threatening nature, with low-intensity “cold genocides,” rooted in victims’ supposed inferiority.

Genocide Studies and Prevention: An International Journal

The semantic field of genocide, cultural genocide, and ethnocide overlaps between Indigenous rights discourse and genocide studies. Since the 1970s, such language has been used to express grievances that have stimulated the construction of Indigenous rights in international law. These particular words signify general concerns with the integrity of Indigenous peoples, thereby undergirding a larger framework of normative beliefs, ethical arguments, and legal claims, especially the right to self-determination. The South China Sea (SCS) is becoming an increasingly contentious source of geopolitical tension due to its significance as an international trade route, possessor of potentially significant oil and natural gas resources, China’s increasing diplomatic and military assertiveness, and the U.S.’ recent and ongoing Pacific Pivot strategy. Countries as varied as China, Taiwan, the Philippines, Indonesia and other adjacent countries have claims on this region’s islands and natural resources. Addressing The 'Failure' Of Informed Consent In Online Data Protection: Learning The Lessons From Behaviour-Aware Regulation, Shara Monteleone

Syracuse Journal of International Law and Commerce

Information notice and data subject's consent are the current main legal safeguards of data protection and privacy rights: they reflect individuals' instances, such as self-determination and control over one's own private sphere, that have been acknowledged in many jurisdictions. However, the theoretic strength of these safeguards appears frustrated by current online practices that seem suggesting to give-up with their most common form of implementation: privacy notices and request for consent. These measures are proving to be unsuccessful in increasing users' awareness and in fostering a privacy protective-behaviour.
