One of the many curious revelations in the increasingly bizarre saga of the presidential pardon of Marc Rich in the twilight hours of the Clinton administration is especially fascinating to the student of international human rights law. Former President Clinton, in justifying the pardon, explained that Mr. Rich was an unheralded human rights activist. Among his apparently numerous, but unacknowledged, good deeds, one stands out for its carefully crafted hypocrisy. Mossad, the Israeli covert action agency, arranged for Mr. Rich secretly to transfer $400,000 to the Egyptian government, which then established a fund to compensate the families of Israeli victims …

Local Institutions, Foreign Investment And Alternative Strategies Of Development: Some Views From Practice, Tamara Lothian, Katharina Pistor

This Essay summarizes the major insights gained from a panel discussion with legal practitioners about the relevance of local institutions to foreign direct investors. The Essay offers a critique of policy conclusions drawn from empirical studies that suggest a positive correlation between legal institutions and foreign investment flows. It points out that the data used in these studies are far too general to allow policy conclusions and that neither the data nor the policy conclusions are sufficiently attuned to the challenges or opportunities that foreign direct investment projects face on the ground. Introductory Note To U.S. Court Of Appeals For The District Of Columbia Circuit: Nemariam, Et. Al. V. Ethiopia, Roger P. Alford

Nemariam v. Ethiopia is one of the most important United States decisions to date addressing whether an international tribunal may be an adequate forum for purposes of dismissing pending litigation based on forum non conveniens. The decision essentially suggests that diplomatic espousal claims before international tribunals can never afford claimants an adequate forum justifying dismissal based on forum non conveniens absent some guarantee of individual relief for meritorious claims.

Is the nature of the international legal system changing? Do we see developments in international relations that challenge the core concepts of international law, rendering the law dys-or non-functional. Professor Karl Zemanek sees indicators of just such change. He writes to arouse our attention to the dangers, urging us to act before it is too late. Professor Zemanek sees the United States tending toward hegemony or even imperialism and argues that these tendencies are already changing international law. This Article will examine the rise of Hindu nationalism in India and provide an overview of its already devastating consequences. In February and March 2002, over 2000 people were killed in state-supported violence against Muslims in the western state of Gujarat, led by the Hindu nationalist BJP that also heads a coalition government at the center. The attacks were carried out with impunity by members of the BJP, the Rashtriya Swayamsevak Sangh (“RSS,” National Volunteer Corps), the Vishwa Hindu Parishad (“VHP,” World Hindu Council), and the Bajrang Dal (the militant youth wing of the VHP). Articulating The Right To Democratic Governance In Africa, Nsongurua J. Udombana

This Article articulates the right to democratic governance in Africa, arguing that democratic entitlement ought to acquire, if indeed it already has not acquired, a degree of legitimacy in the continent. If democratic governance is a fundamental human right, which this Article asserts it is, it follows that any African State that denies its citizens the right to any of the elements of democratic entitlement-such as free and open elections-is violating a fundamental right, which should attract responsibility. Although a perennial feature of global politics, separatist movements had scant prospect of success for nearly half a century after World War II. And so the recent proliferation of new states has shattered settled expectations. In the 1990s, Yugoslavia fractured into five states, the Soviet Union split into fifteen, Eritrea separated from Ethiopia, Czechoslovakia divided into the Czech Republic and Slovakia, and East Timor won independence from Indonesia. In this essay, the author analyzes the regulation of trademarks in the NAFTA and its influence on Mexico's legislation on that matter. In the first part, the author explains in general terms the content of the NAFTA, and afterwards, he refers to the rules of Chapter XVII on industrial property. Moreover, he explains the protection derived from this agreement in connection with trademarks, and later, he refers to the normative framework of trademarks in Mexico, which is a result both of legislation and international treaties. The Economics Of Uniform Laws And Uniform Law Making, John Linarelli

Uniform law making has a substantial history in the twentieth century. It seems to be continuing with some force into the twenty-first century. A significant American law and economics literature, however, questions its merit. By contrast, there have been limited rational choice oriented investigations of unification or centralization of law in Europe. Critics of the uniform law movement in the United States use methods of analysis influenced by public choice theory, political economics and positive political theory.
