Book Review: Limits Of Law, Prerogatives Of Power: Interventionism After Kosovo, By Michael J. Glennon, Charles Tiefer

The author reviews Michael Glennon's Limits of Law, Prerogatives of Power: Interventionism After Kosovo, discussing Glennon's approach to NATO's 1999 bombing to stop the Milosevic regime's ethnic cleansing of Kosovo in the face of the UN Charter's absolute ban on states using force except in self-defense. Finding Glennon's study at once provocative and readable, the author emphasizes the strength of Glennon's core point - the inability for the Kosovo campaign to be reconciled with the UN charter - but points to the dangers of using one instance (Kosovo) to prove bad law.

Harmony And Diversity In Global Patent Law, John F. Duffy

The second half of the twentieth century saw the rise of a broad movement to harmonize patent laws across nation-states. The most recent, and most significant, manifestation of this movement is the 1994 TRIPS Agreement, which requires signatory nations to adopt uniform rules on many major issues of patent law. The TRIPS Agreement has now been implemented by well over one hundred countries, including almost all major industrial nations, and it heralds a new level of international uniformity in patent law.

Palestinian Refugees And Their Legal Status: Rights, Politics, And Implications For A Just Solution, Susan M. Akram

The Palestinian refugee problem is one of the longest-lasting refugee crises in the world——now exceeding fifty-three years——without a real solution in sight. Although at its core a political problem, the Palestinian refugee crisis is also a problem of legal distortion: Palestinian refugees fall into a legal lacuna that sets them outside minimal international protections available for all other refugee groups in the world. This paper provides background to the legal anomaly that sets Palestinian refugees apart; discusses the legal, practical, and political implications of that status; and proposes a framework and mechanisms aimed at promoting a rights-based solution for the …

East European Security Revisited: Institutions, Power, And Security, Blagovest Tashev

Drawing on the literatures on democratization, security studies, and small states this dissertation explores the relationship of small states' domestic and international institutionalization and their security. Small states have limited power not only to affect their environment but also to guarantee national security. Small states, it is hypothesized, enhance their security through the consolidation of domestic institutions and the accumulation of capacities provided by their participation in capacity-reach international institutions.
The dissertation tests the hypothesis by applying the comparative method to the post-communist states of Bulgaria, the Czech Republic, and Lithuania. The three case studies analyze the effects of domestic …

Askin is a fellow at the Carr Center for Human Rights Policy at Harvard University as well as a legal consultant to the United Nations and other world agencies in the areas of international humanitarian and criminal law. She has previously served as acting executive director of the War Crimes Research Office at the Center for Human Rights and Humanitarian Law, Washington College of Law, American University. She teaches primarily in the areas of international humanitarian law and international gender issues. As it becomes increasingly clear that the International Criminal Court will be set up in the near future, it is important to reflect on the work of the Preparatory Commission for the International Criminal Court. When the Rome Statute was being negotiated, it became very clear that additional documents would be necessary in order to create a fully functioning ICC. At the time, eight such documents were identified and included in Resolution F of the Final Act of the Rome Diplomatic conference. As work on these documents nears completion, States have begun to consider the practicalities of setting up the …
