Freud As Law Professor: An Alternative History, Charles Yablon
Freud As Law Professor: An Alternative History, Charles Yablon
Cardozo Law Review
We are gathered here today to pay tribute to one of the great legal minds of the twentieth century. In his long and fruitful career as lawyer, law professor, and legal theorist, Sigmund Freud literally revolutionized both the theory and practice of the legal profession. His contributions are to be found everywhere; from his early work on alternative dispute resolution, to his fundamental reconceptualization of the lawyer-client relationship, to his trenchant critiques of the law and economics movement, even the standard fifty-minute billable hour are all reflections of his vast influence on law and legal theory.

Foreign Private Investment In Palestine: An Analysis Of The Law On The Encouragement Of Investment In Palestine, David P. Fidler
Fordham International Law Journal
This Article analyzes the Investment Law and its prospects for encouraging foreign businesses to invest in Gaza and the West Bank (collectively, "Palestinian Territories"). A brief analysis of the importance of foreign private investment to the peace process between Israel and the Palestinian Liberation Organization, and the progress made towards attracting such investment in Gaza and the West Bank since the September 1993 signing of the Declaration of Principles on Interim Self-Government Arrangements, serves as a prelude to a detailed examination of the text of the Investment Law. The author then compares the Investment Law to the latest international practices …
Informed Choice And Population Policy: Do The Population Policies Of China And The United States Respect And Ensure Women's Right To Informed Choice?, L. M. Cirando
Fordham International Law Journal
This Note argues that, in light of the veiws emphasized at the Cairo Conference, the population policies of China and the United States violate women's rights by denying women the opportunity to make voluntary choices regarding child-bearing and fertility regulation. Part I discusses the involvement of the United Nations with population policy-making and summarizes two U.N.-sponsored international population policy action plans. Part II presents the population policies of China and the United States, examines their rationales for implementation, and explains how the policies affect women's reproductive choices. Part III argues that the population policies of China and the United States …

Why Redraw The Map Of Africa: A Legal And Moral Inquiry, Makau Wa Mutua
Why Redraw The Map Of Africa: A Legal And Moral Inquiry, Makau Wa Mutua
Journal Articles
This article questions the legitimacy of the African state and the imperial cartography on which it is based. It argues that African states are conceptually faulty because they are the crude and thoughtless handiworks of European colonial powers. It is the artificiality of the African state that has been responsible for its failure to cohere into a nation that is viable. The piece argues for geographic and normative re-articulation of the African state - by smashing the current states - to endow them with moral, political, and legal legitimacy. It concludes that democratic entities are unlikely to develop where pre-colonial …

Strategic Alliances: Emerging Trends In Future Corporate Business, Naresh Menghraj Gehi
LLM Theses and Essays
A strategic alliance is an arrangement for economic collaboration between firms at the same level of distribution, involving an exchange of critical skills aimed at buffering the core business strategy, technology, or markets of the partners. Research indicates that the care and thought of the strategic alliance partners increases with the importance of the venture to the strategic objectives of the entity. This paper describes the importance of strategic alliances in today’s competitive world. It examines the benefits of entering into strategic alliances, the legal implications of strategic alliances, and various industries where strategic alliances are dominant. Finally, this paper …
