After a detailed examination of the unique position of the emerging nations, the "third 'world," Professor Fatouros urges that the Western nations should ndertake a change in approach and a reassessment of the objectives of international law since the present situation of international society is so dissimilar to that in which the law evolved. He concludes that special, new rules should be formulated, based on a broad and positive consideration of the urgent need of the emerging nations to develop their natural resources as effectively and as rapidly as possible-a need 'which international law must take into account if it …

In this issue, one of the United States Counsel at the Tokyo War Crimes Trial examines the legal and historical background of that trial which took place in Japan following World War II. Judge Robinson centers his discussion around the little-known provisions of the Convention Relative to the Opening of Hostilities, which was signed at The Hague in 1907. One of the primary purposes of that convention was to outlaw surprise attack such as that committed by the Japanese at Pearl Harbor. This is the concluding portion of Judge Robinson's discussion of the Convention Relative to the Opening of Hostilities, signed at The Hague in 1907 (the "Third Hague Convention"), and its impact upon the 1948 Tokyo war crimes trial. Judge Robinson was United States counsel and naval legal officer in charge of the Pearl Harbor phase and other parts of the Tokyo trial. The first portion of his article appeared in the September issue of the Journal, beginning at page 973.

The recent proposal to amend the Constitution known as the Bricker Amendment concerns a most vital matter for the nation: its relations with foreign states.
In order to estimate the merits and demerits of the Bricker Amendment it is necessary to get acquainted with the historical development and the constitutional interpretation in the field of international arrangements of the United States. The present observations aim at the presentation of this matter down to the Bricker Amendment. The Amendment itself and the discussion it aroused should be treated in a separate article.
