Inclusion-focused dating shows such as ‘Love on the Spectrum’ feature individuals with developmental or neurological disabilities on a quest for love. Despite the focus on disability representation, these shows perpetuate stigma against the disabled community by fostering an infantilizing portrayal of individuals with disabilities. This portrayal undermines the premise of encouraging meaningful romantic relationships and reinforces the stigmatizing association of asexuality with disability. This framing aligns with the broader societal narrative that individuals with disabilities are incapable of or lack interest in participating in romantic relationships or physical intimacy.

The stigma that associates asexuality with disability extends beyond mere entertainment, …

Beyond The Rings: Housing Inequalities In Olympic Host Cities, Audrey Hansen

Cardozo Arts & Entertainment Law Journal

The note argues that hosting the Olympic Games consistently leads host cities to violate their citizens' right to adequate housing through displacement, gentrification, and the criminalization of homelessness. By analyzing historical patterns and current preparations for the 2028 Los Angeles Games, the analysis contends that the traditional single-city hosting model is unsustainable and harmful.

Integrating Human Rights Into State And Federal Court Litigation, Lauren E. Bartlett

Human rights have never been more important in the United States as they are today. After more than 10 years of dormancy, the seminal work that guides public interest attorneys in incorporating human rights work has been finally updated. The Human Rights in the U.S. Handbook for Public Interest Attorneys is a handbook that provides practical direction to public interest attorneys, including clinical law teachers, legal aid attorneys, public defenders, and others, on how to use human rights in their everyday work. The Handbook invaluably advises attorneys on best practices for using human rights arguments before U.S. state and federal …

The New Neccesity, Ezra Rosser

Scholarly Articles in Law Reviews & Journals

According to the U.S. Supreme Court, cities are free to criminalize homelessness. The 2024 case City of Grants Pass v. Johnson is the most important homelessness case in decades and was a significant blow to advocates for the unhoused. The conservative majority rejected the idea that city ordinances criminalizing sleeping in public amounted to cruel and unusual punishment insofar as they penalized status. There is no sidestepping the loss. But within the faint glow of the embers of the oral argument and of the decision itself, there is the possibility that a new understanding of necessity, supported by the same …

An International Framework For Marriage Promotion, Jessica Tueller

Faculty Articles

Governments across the globe lately have been raising the alarm about declining marriage rates and adopting a wide variety of measures to increase these rates. This article presents a framework, distilled from human rights law, for assessing whether such measures are in keeping with States’ international obligations to eliminate all forms of coercion and discrimination in their policies and practices concerning diverse family structure and composition. The framework draws clear boundaries between measures that are permissible under human rights law and measures that are prohibited by human rights law. It also provides a tool for evaluating marriage-promotion measures that, although …

Invisible, Manipulated, And Politicised: Rethinking The Conceptual Foundations Of The Un Convention On The Rights Of The Child, Anshul Dalmia Jan 2026

Invisible, Manipulated, And Politicised: Rethinking The Conceptual Foundations Of The Un Convention On The Rights Of The Child, Anshul Dalmia

National Law School of India Review

This paper examines whether the rights articulated in the United Nations Convention on the Rights of the Child (‘UNCRC’) can be meaningfully assimilated within the broader framework of international human rights. It locates this inquiry within enduring jurisprudential debates on the nature, justification, and enforceability of children’s rights. While international human rights law presumes a relatively stable rights-bearing subject, children occupy an ambivalent position—simultaneously recognised as rights-holders and as dependents mediated through an adult authority. Drawing on Tobin’s critique, which cautions against the dangers of conceptual indeterminacy, the paper argues that the UNCRC exemplifies these risks. It contends that the …

The Human Rights Argumentation Of The Uoc-Mp As A Strategy Of Institutional Self-Preservation Under Conditions Of Armed Aggression, Mariia Rudiuk, Valeriy Bulatov

Occasional Papers on Religion in Eastern Europe

The article examines the strategy of institutional self-preservation employed by the Ukrainian Orthodox Church of the Moscow Patriarchate (UOC-MP) under conditions of Russian armed aggression. The relevance of the topic is determined by the adoption of Law of Ukraine No. 3894-IX “On the Protection of the Constitutional Order in the Sphere of Activities of Religious Organizations,” aimed at limiting the influence of religious structures affiliated with the aggressor state. Particular attention is devoted to the ways in which the UOC-MP utilizes democratic legal mechanisms and European human rights rhetoric in order to delay or neutralize Ukraine’s national security measures. The …

As an effort to concretize ethics, there is a process of formalizing ethics into a set of rules through a code of ethics. The code of ethics needs institutional enforcement instruments so that it can be effectively applied through ethical trials. Ethical courts, as institutions that adjudicate violations of the code of ethics, have the authority to issue decisions as a follow-up to cases of violations of the code of ethics that they handle. In carrying out its duties, ethical courts use ethical and moral analysis to assess the appropriateness of an action. This analytical approach differs from legal decisions …

Copyright is one form of legal protection for intellectual works, occupying an important position within the intellectual property law system. The Copyright Law explicitly grants exclusive rights to creators, encompassing both moral rights and economic rights. Economic rights, as stipulated in Article 9 paragraph (1), allow creators to obtain economic benefits from their works, ranging from publication, reproduction, distribution, performance, to communication to the public. This provision shows that creators hold a primary position as legal subjects entitled to protection, while also serving as central actors in the creative industry ecosystem. In practice, the mechanism for copyright protection requires implementing …

Debt to Equity Swap (DES) under a composition plan in Suspension of Debt Payment Obligations (PKPU) proceedings constitutes a restructuring mechanism that transforms the legal status of a Creditor into that of a shareholder upon homologation. Legal issues arise when The Debtor subsequently enters a Second PKPU due to newly incurred debts or is declared bankrupt following the annulment of the composition, while Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment does not expressly regulate the legal consequences of a DES under such circumstances.
