Considering The Child’S Wishes—But How? Allowing Children To Speak In Their Custody Matters, Joshua Hanson

In the United States, states universally may consider the child’s wishes when determining their custody placement. While their decision or preference is not binding for the judge, it allows the child meaningful participation in decisions that directly affect them. There are many ways courts can ensure a child’s voice is heard: through an interview with the judge, professional evaluations, child advocates, and even child-inclusive mediation. Yet state laws give judges broad discretion when determining how to weigh the child’s wishes.

This article first describes shifts in human rights law that have led to improvements in the realization of sexual and reproductive health and rights (SRHR) over the last decade. The article does so, however, with careful attention to the structural factors beyond formal legal mechanisms that may undermine the ability of governments, even with the best of intentions, to fully develop the necessary robust health and justice systems. The phenomenon of single candidates in regional elections in Indonesia has created a dilemma in applying democratic principles, especially regarding ballot design that often confuses voters. The Constitutional Court’s Decision Number 100/PUU-XIII/2015 mandated a plebiscite design with “agree” or “disagree” options for single candidates. However, in practice, this design has been distorted with the presence of a blank box without adequate explanation. As one of the institutions that carries out quasi-judicial functions in the field of general elections, Bawaslu could issue a decision through an adjudication process. In 2017, Bawaslu was criticized for its several decisions in the Sipol case held by the KPU for the registration of participants in the 2019 general elections, mainly because it was considered that Bawaslu equated its position with the Supreme Court by assessing that Sipol in the KPU Regulation was not in line with the Election Law. This paper explores how intergenerational dialogue and inquiry (IDI) may help break the silence about past brutality and contribute to collective healing, social justice and communal well-being. The specific historical contexts that it is concerned with are transatlantic slavery and colonisation, and the continued legacies of contemporary racism. In this keynote address, I describe my personal journey starting with a school outreach program I created in 2017 to address technology overuse among kids. While I initially advocated for self-help methods, I grew to recognize that the tech industry bore responsibility. This realization led me to write Unwired: Gaining Control over Addictive Technologies, which focused on collective action to pressure the tech industry to redesign its addictive products.

I then describe the movement to control addictive technologies and protect kids, which has gained momentum since the end of the pandemic. This movement combines grassroots parent activism with legal-political action. …

With the rise of generative artificial intelligence (AI), there has been an influx of “voice clones”—deep-learning algorithms that create synthetic speech to realistically mimic human voices. Celebrities and, in particular, music artists, have been subjected to the proliferation of AI voice clones on social media platforms like TikTok and streaming platforms such as Spotify. In response to public concern about the impact of social media, legislators in some U.S. states have developed laws to regulate the process of content moderation. Many include mandatory transparency and disclosure requirements, some of which courts have already deemed an unconstitutional infringement on social media platforms’ right to free expression. This article explores the parameters for crafting constitutional social media transparency regulations using existing U.S. media policy and insights from recent legal challenges. Artificial Intelligence (AI) agents have become an inescapable part of modern childhood, reshaping education, leisure activities, entertainment, and social interaction. From AI-powered tutors that adapt to individual learning styles to emotionally responsive chatbots that simulate human companionship, these systems promise unprecedented personalization, cognitive stimulation, and social support. However, these benefits mask significant risks that remain unregulated and inadequately addressed.

On Thursday, the International Criminal Court (ICC) announced it had issued arrest warrants for Benjamin Netanyahu, the Prime Minister of Israel, and Yoav Gallant, the former defense minister, in connection with alleged crimes committed in the ongoing armed conflict between Israel and Hamas. In doing so, the Court rejected as premature Israel’s challenge to the Court’s jurisdiction. In the mid-1840s, American settlers flocked westward on the Oregon Trail, unknowingly bringing with them measles and other foreign diseases to which the Cayuse peoples along the trail had no immunity. Hundreds of Cayuse children were brought to Narcissa and Marcus Whitman at the Whitman Mission for treatment, but ultimately these children could not be saved. From Deliberate Indifference To Civil Negligence: Protecting Male Prisoners From Sexual Violence In United States Prisons, Olivia Martini

Sexual violence in United States prisons is a pervasive issue that disproportionately impacts male inmates, revealing systemic failures in the current legal framework designed to protect incarcerated individuals. The deliberate indifference standard, established by the United States Supreme Court, imposes an excessively high burden of proof on survivors, requiring evidence of prison officials’ subjective awareness of specific, substantial risks.

This article critiques the shortcomings of the deliberate indifference standard and proposes a civil negligence framework as a promising alternative. Grounded in an objective duty of care, a civil negligence approach emphasizes proactive measures that institutions must take to avoid liability. …
