A-R-C-G- Is Not The Solution For Domestic Violence Victims, Lizbeth Chow

For over fifteen years, U.S. immigration authorities and courts have grappled with the idea of domestic violence as a basis for asylum. But in 2014, the Board of Immigration Appeals (BIA) issued a decision indicating that victims of domestic violence may qualify for asylum. This Comment assesses the BIA’s decision and concludes that it is ultimately ineffective. This Comment further suggests that the only practical solution is for Congress to intervene. This Comment first provides a brief historical overview of asylum law to help elucidate the purpose of asylum law. It also provides an in-depth review of the elements needed …

Some have urged law libraries to undergo what appears to be a large-scale transformation, where access to justice in incorporated as a core feature of the library mission. While Access to Justice (A2J) services are provided by many libraries, they can be seen by law library managers as costly, unfunded mandate. One way of approaching the issue is to consider library access to justice services as a continuum within the broader range of legal services. The discriminatory effects that may stem from biometric ID cybersurveillance and other algorithmically driven screening technologies can be better understood through the analytical prism of “crimmigration-counterterrorism”: the conflation of crime, immigration, and counterterrorism policy. The historical genesis for this phenomenon can be traced back to multiple migration law developments, including the Chinese Exclusion Act of 1882. To implement stricter immigration controls at the border and interior, both the federal and state governments developed immigration enforcement schemes that depended upon both biometric identification documents and immigration screening protocols. This Article uses contemporary attempts to implement an expanded regime of “extreme vetting” …

Attacks on birthright citizenship periodically emerge in the United States, particularly during presidential election cycles. Indeed, blaming immigrants for the country’s woes is a common strategy for conservative politicians, and the campaign leading up to the 2016 presidential election was not an exception. Several of the Republican presidential candidates raised the issue, with President Donald Trump making it the hallmark of his immigration reform platform. Trump promised that, if elected, his administration would “end birthright citizenship.” In the Dominican Republic, ending birthright citizenship and curbing immigration are now enshrined into law, resulting from a significant constitutional redefinition of Dominican citizenship …

Humanizing Intellectual Property: Moving Beyond The Natural Rights Property Focus, J. Janewa Oseitutu

This Article compares the natural rights property framework with the human rights framework for intellectual property. These two frameworks share a common theoretical basis in the natural rights tradition, but they appear to lead to conflicting outcomes. Proponents of natural rights to intellectual property tend to support more expansive intellectual property protections. Advocates of a human rights approach to intellectual property contend, however, that human rights will have a moderating influence on intellectual property law. The global intellectual property structure has been criticised for requiring developing nations to adopt intellectual property standards that are appropriate for industrialised countries. Some commentators have observed that industrialised nations, such as the United States, developed their economies by borrowing from others, but that through the use of globalised intellectual property standards, they have effectively limited other nations from doing the same. This article does not aim to revisit the question of the suitability of the existing intellectual property standards for developing countries. Working closely with women's testimonies from the genocides in the former Yugoslavia and Rwanda, this chapter aims to widen space in contemporary human rights discourse for discussion about sexuality--and in particular about the ways sexual violence functions as one of the forces of sovereign power. There is an intimate and largely non-visible strategy that sovereign power has at its disposal to cleave a subject from their capacity to live a human life, namely, by attacking the individual’s sense of sovereignty over her own body.

The current regime of international human rights suffers from three shortcomings: First, it has failed to adequately address the reality of cultural diversity. Second, the formalized human rights treaties have been ineffective in their ability to compel states to reform their behaviors, and third, the uncontrolled growth in the number of human rights weakens the impact of appeals to that standard.

Human trafficking finally presents a crime that appropriately shifts the culpability from the abused to the abuser. As the heinous world of human trafficking is studied and more is understood about its inner workings, we can no longer conflate victimization with over-criminalization.
