This paper explores how administrative law can mitigate the democracy deficit that may occur when privatization shifts political debate into relatively private arenas, changes its focus, or precludes debate altogether.I t also argues that the prevailing form and key terms of globalization in the United States derive from neo-liberalism, particularly in the binary division of public/private and their conflation with legal regulation and market responsiveness, respectively. This article addresses the role of public contracts and of public-private networks in relation to the new cognitive infrastructure of postmodern societies and the rise of an experimental rationality. The use of contracts in public law has evolved: it is no longer just a new version of the administrative decision; it is now used as a means in a broad process of breaking up the permeability of public administration. The source selection process for choosing a contractor does not incorporate a standardized objective decision analysis tool; therefore, the process is extremely subjective and provides little guidance to distinguish between highly competitive contractors. The Air Force Simplified Acquisition of Base Engineer Requirements (SABER) program selects contractors through a Low Price Technically Acceptable (LPTA) source selection process and encounters the same problem of not being able to objectively distinguish between the competing contractors. The LPTA process rank orders the contractors based on price and evaluates the bidders in order until an 'exceptional' contractor is discovered. However, the SABER source selection committee …

This thesis explores the role of SB contractors in Air Force (AF) procurement and the effects of recent acquisition reform (AR) initiatives on their involvement, including their method of involvement (contract type), product areas in which they participate, and possible new areas of measurement. This thesis answers the research and investigative questions in three ways. Public agencies are also required to accept the lowest "responsive" and "responsible" bid. A "responsive bid is one which has addressed all the requirements of the bid documents. This study investigated if differences exist in the cost and schedule growth of competed versus sole source contracts. Prior studies concentrated mainly on estimated savings from competition at the time of contract award. This study expanded prior analysis by investigating the cost and schedule growth over the contract's period of performance. In addition to an analysis between competed and sole source contracts, this study investigated if differences exist between lower and higher risk contracts as well as lower and higher initial priced contracts. The objective of this research was to develop a framework for a standardized Air Force Contingency Contracting course. This task was undertaken due to the occurrence of a common recommendation calling for specialized training in Contingency Contracting. The recommendation was found in several AFIT theses, as well as, various after action reports generated due to the experience gained during Operation Desert Shield/Storm and Hurricane Andrew. This thesis answered the basic questions of need, content, and structure for a future course in Contingency Contracting. An Analysis Of Contracting Actions By United States Based Department Of Defense Organizations To Support Operations Desert Shield And Desert Storm, Kathleen E. Killen, Gavin P. Wilson

This study assembled the experiences of the contracting professionals who supported Operations Desert Shield and Desert Storm from their continental United States based Department of Defense offices. The results of the study show that these professionals actively supported the conflict just as much as the contingency contracting officers who were deployed to the Middle East. No major differences in contracting methods appeared among the different agencies studied. However, the study does suggest that certain regulations should be considered for changes or waivers that go into effect during military contingencies.
