Electronic sports, “esports,” is a rapidly growing industry throughout the world. The global gaming market was valued to be worth approximately 221.24 billion USD in 2024 and is expected to reach 424.23 billion USD by 2033. It is expected that as technology continues to improve and there are less barriers to access gaming, such as cloud gaming which allows players to access games without expensive hardware, the market for games will continue to grow. At a doctrinal level, the subject of this Article is timely. During this time of the coronavirus pandemic, casinos have been closed and large populations have been subject to stay-home orders from local and state authorities. One can reasonably expect a large increase in electronic gaming and thus an increased need for proper consideration of its taxation. This Article argues for a cash-out rule of taxation.

Social games—and social casino games— have exploded in popularity. As of 2012, 800 million people, or 12 percent of the world’s population, were playing social games at least once per month. That number is expected to double to 1.5 billion by the end of 2015.To put that number in perspective, as of 2012, only 50 million people are believed to have participated on real-money online gambling sites. Ecommerce Market Convergence In Action: Social Casinos And Real Money Gambling, Brett Abarbanel, Ardeshir Rahman

The social casino and real money gambling industries, including gambling at online and live venues (such as casino resorts), are quickly converging (H2 Gambling Capital & Odobo, 2013). Differences in demographics and gambling behaviors for different frequencies of social casino participation among real money online gamblers are examined to explore customer behaviors between the two markets. Frequency of play in social casino games varied depending on gender and education, similar to patterns in real money gambling. The legal status of gaming activities on First Nations land within Canada is complicated. The foci of this paper are two-fold. First, we trace the origin and expansion of First Nations gaming. Second, we analyze the potential of First Nations as hubs for the growing global e-gaming industry, with an emphasis on Internet poker and online sports wagering. We conclude by positing that the Canadian regulatory scheme presents an opportunity to First Nations in connection with e-gaming.

In light of the potential income generating capability of online gambling and its perceivable threat to location based gambling, this Article examines the legality of banning online gambling despite the promulgation of the National Gambling Amendment Act, which is intended to legalize online gambling, and the constitutional implications of such ban. Part II examines the definition of gambling to argue that online gambling is a mere component of gambling.
