Online cryptocurrency casinos have seen a dramatic rise in popularity over the past thirty years as the rate of ownership of cryptocurrencies has risen almost as quickly as the US monetary value of a single Bitcoin. Current US laws and regulations are outdated; the only piece of federal legislation that provides oversight in the area of virtual gambling originated in 2006, more than fifteen years before the publication of this Note. Legalized sports gambling has become one of the hottest topics in state legislatures ever since the United States Supreme Court’s 2018 decision in Murphy v. National Collegiate Athletic Ass’n1 allowed states to begin legalizing the activity. As states began to offer sports wagering, gambling became front and center in the news and the Trump administration’s Justice Department took the opportunity to rewrite a 2011 Office of Legal Counsel opinion, expanding the scope of the most prominent federal anti-gambling statute. In recent months, the legal status of fantasy sports has undergone intense scrutiny, with the attorneys general of many states contending that certain formats of daily fantasy sports violate state gambling laws. In an effort to save the burgeoning daily fantasy sports industry, legislators in these states have proposed bills to affirmatively legalize and regulate daily fantasy sports. However, these bills often fail to adequately address the underlying consumer protection concerns pertaining to the industry.

Internet Casino-Style Gambling: Is It Legal In Nevada?, Marc G. Warren

The State of Nevada, to retain its position as pace setter in U.S. casino gaming regulation, took important legislative steps to prepare for online gambling. When these legal efforts were discouraged or blocked by the U. S. Department of Justice a new direction emerged. This article traces the shift from implementing online gambling across state lines to intrastate gaming within Nevada with hand-held devices in auxiliary areas of a casino complex beyond the casino floor. Regulatory issues are raised and prospects for inaugurating interactive gaming are discussed.

Recently, there has been increased pressure on the U.S. Congress to act against Internet gambling. While it may be tempting for terrestrial casinos to watch idly as the federal government moves to eliminate a potential competitor, those in the business of gaming must be leery of any federal efforts to halt gambling online. In the final analysis, the same arguments to restrict consumer choice in cyberspace can be easily used against gambling in real casinos-a compelling reason for terrestrial gaming operators to forcefully oppose any federal restrictions on Americans' rights to gamble.

The Effect Of Online Gaming On Commercial Casino Revenue, Kahlil S. Philander

This study estimates the effect of the online gaming industry on the commercial casino gaming industry. The findings from this study suggest that during the pre-UIGEA period, online gaming was a moderate substitute good for brick and mortar gaming in the U.S. During this early period in the online gaming market, which was characterized by loose regulation and relatively easy access, online gaming revenue is estimated to have cannibalized commercial casino revenue at a rate of 27 to 30 cents on the dollar. In 2005 the gaming market was worth an estimated six billion dollars, half of that represented by online gambling revenues. However not all jurisdictions (countries) regulate the industry the same. Some jurisdictions allow the industry to flourish while some go as far as banning the industry all together. I gather data on all 75 global jurisdictions that have some form of online gaming. I analyze which regulations allow the industry to prosper while maintaining quality standards, and which regulations do not work. Over time, the US sports gaming industry has progressed dramatically beyond what the US anti-gaming law drafters envisioned. The result is a system of mostly antiquated laws controlling modern industry causing confusion across the board. This discussion, therefore, intends to shed light on the US sports gaming legal framework, including analysis of the preeminent US laws that regulate the sports gaming industry and a brief review of various sports gaming businesses that fall within the US legal rubric.

In recent years, gambling on the Internet has evolved into a multi-billion dollar enterprise. The industry has been particularly entrenched in the United States, whose citizens at one time accounted for up to one-half of all Internet gambling revenues. However, the landscape of Internet gambling in the United States changed drastically in 2006, when President George W Bush signed into law the Unlawful Internet Gambling Enforcement Act (UIGEA).
