The Hunt For Loot: Proposed Solutions To More Effectively Regulate Addictive Gambling Mechanics In Video Games, Andrew Brewer

Journal of Law and Policy

Over the past decade, more and more video game developers have embraced “loot boxes” as a lucrative source of revenue. But recent concerns over the potential harms of loot boxes, particularly to children, have raised questions about their use and prompted attempts to regulate them throughout the world. This Note explores recent attempts—both foreign and domestic—to regulate loot boxes and proposes new solutions based on those strategies’ shortcomings. By carefully and competently defining terms and exceptions, and providing for more aggressive oversight of agency regulatory efforts, federally-crafted loot box legislation can more effectively protect children from predatory gambling mechanics in …

Sports betting plays a major role in how fans and spectators enjoy sports. Fans place bets in their living rooms, engage in online fantasy sports, and travel to Nevada for massive Super Bowl parties just for the thrill of wagering on the “big game.” Yet, until 2018, the federal government banned sports betting, making states unable to exploit this lucrative business, even though the sports betting industry estimates that billions of dollars are spent on illegitimate sports wagering. Talking About Casino Gambling: Community Voices From Boston Chinatown, Carolyn Wong, Giles Li

Institute for Asian American Studies Publications

This pilot study examined the casino gambling practices of residents and workers in Boston Chinatown. The aim was to learn about the trajectory and life context of individual participants’ gambling activity, including how individual participants describe their motivation, nature and frequency of gambling, and its effects on self and family. The research was conducted by a university based research team in partnership with the Boston Chinatown Neighborhood Center, and with the assistance of the Massachusetts Council on Compulsive Gambling.

The stories told by participants illustrate multiple and overlapping risk factors for problem gambling. Our conceptual approach took into account the …

Legalized sports gambling has become one of the hottest topics in state legislatures ever since the United States Supreme Court’s 2018 decision in Murphy v. National Collegiate Athletic Ass’n1 allowed states to begin legalizing the activity. As states began to offer sports wagering, gambling became front and center in the news and the Trump administration’s Justice Department took the opportunity to rewrite a 2011 Office of Legal Counsel opinion, expanding the scope of the most prominent federal anti-gambling statute. At a doctrinal level, the subject of this Article is timely. During this time of the coronavirus pandemic, casinos have been closed and large populations have been subject to stay-home orders from local and state authorities. One can reasonably expect a large increase in electronic gaming and thus an increased need for proper consideration of its taxation. This Article argues for a cash-out rule of taxation.

In May of 2018, the United States Supreme Court held in Murphy v. National Collegiate Athletic Association that a federal prohibition on sports gambling was in violation of the anti-commandeering doctrine of the Tenth Amendment. In the wake of the decision, many commentators have opined that the opinion, authored by Justice Alito, may have serious implications on contentious political issues ranging from marijuana legalization to sanctuary cities. Texas takes pride in its unique Western heritage and its adventurously independent spirit. However; the Texas Legislature has spurned a widely popular and uniquely Texan pastime, Texas Hold 'E. Despite praising Texas's cultivation of Texas Hold 'Em, Texas low condemns participation in the game to the secrecy of Texans homes. Tronically, while maintaining an allegedly strict stance against commercial gambling, Texas manages its own lottery and administers pari-mutuel wagering on dog and horse racing tracks.
