In 2000, Sir Alan Budd, the noted economist was asked by the British Government to chair a review of the nation’s gambling laws. The resulting ‘The Report of the Gambling Review Body’ (referred to here as ‘The Budd Report’ or ‘Budd’) was published a year later and provided a blueprint for how gaming and betting would subsequently be regulated under a major new piece of legislation - the Gambling Act 2005 (the ‘2005 Act’ or the ‘Gambling Act’).

Loyalty programs are popular marketing strategies developed for the purpose of attracting, maintaining, and enhancing customer relationships. Social games—and social casino games— have exploded in popularity. As of 2012, 800 million people, or 12 percent of the world’s population, were playing social games at least once per month. That number is expected to double to 1.5 billion by the end of 2015.To put that number in perspective, as of 2012, only 50 million people are believed to have participated on real-money online gambling sites. The liberalisation of the gambling advertising facilitated in the UK by the Gambling Act 2005 led to a natural but phenomenal overall expansion of gambling advertising. While any claims that such gambling marketing may lead to harm continue to be strongly contested, it is at least implicitly accepted that some vulnerable persons, including minors, may require specific protection as mandated by the statutory licensing objective. In the UK this is aimed to be achieved by ensuring that gambling advertisements are ‘socially responsible’ and by the timing/placement restrictions. Gaming activities play important social, cultural, and economic roles for many Native American tribes. During the 1970s and 1980s, gaming activities spread throughout the country, and became more accessible to nonnative individuals. This growth in gaming activities drew the attention of state and local officials who sought to limit and regulate Native American gaming. In California v. Cabazon Band of Mission Indians, the State of California, arguing before the Supreme Court, asserted that it could exercise jurisdiction over Native American gaming activities. Whether in the form of lotto tickets or casino table games, gambling is legally permitted in some way in virtually every U.S. state. Yet, in all but a handful of jurisdictions, federal law prohibits wagering on sporting events or professional athletes in any form. Several economically challenged states, particularly New Jersey, have been trying to authorize sports gambling within their borders as a way to raise tax revenues and support their local gambling industries.
