This volume, the first in Ernst Rabel's monumental comparative treatise on the conflict of laws, was initially published in 1945. Since then three additional volumes have been added, completing the survey of the systems of conflicts law as originally contemplated. Therapeutic Approach To Divorce Proceedings, Marcus G. Raskin, Sanford N. Katz

The concept of fault -the placing of blame on one party- has no place in the therapeutic approach to divorce cases. If we consider the concept of fault in a different sense, namely, misconduct contributing to the disruption of the marital relation, then the concept becomes workable. The marriage counselor's primary function is not to determine which party's misconduct has caused the discord. The therapeutic approach is based on a relational misconduct. That is, it applies when both parties are responsible for the breakup. The aim of the therapeutic approach is not to "reward the innocent and punish the guilty." …

It is settled law in this state that a widow whose dower has not been assigned is not a competent party plaintiff in a partition suit. She has no estate in the land until her dower is assigned and therefore is not a joint tenant, a tenant in common, or a coparcener with her husband's heirs.

The Attorney General of West Virginia, in a recently released opinion, takes the position that the child welfare provisions of the West Virginia Code, as amended, do not preclude criminal prosecution of juveniles in the circuit courts or other courts having criminal jurisdiction. The importance of the opinion and its possible effect on the future handling of criminal charges against juveniles require a close examination of the juvenile court provisions of the Code and the cases interpreting them.

Fourteen states now have statutes imposing vicarious liability upon parents for tortious acts of their children. These statutes, with one exception, all have been enacted within the past six years, and they present the most significant attempt to date by legislatures to control the incidence and remedy the effects of juvenile vandalism. The parental liability laws vary with respect to the ages of the children covered, and they place different pecuniary limits on the extent of the parent's liability. Coverage may extend to personal injuries as well as to property damage. All except the Louisiana statute, however, apply only to …

John and Maltie Preston moved onto a parcel of land in 1910 where they lived until 1950 when John died intestate. Maltie died intestate in 1954. Title to the land had been perfected by twenty years adverse possession. Evidence showed that the adverse possession was intended to inure to their joint benefit. Complainants, collateral heirs of John, sued in ejectment claiming that John took the whole title by exclusive adverse possession.
