This Comment will first examine whether the equal protection or due process clauses of the Constitution presently proscribe disparate treatment of the putative father, as compared with other parents, in regard to parental privileges. Attention will then be given to an assessment of the potential impact of the proposed "equal rights" amendment on the putative father's rights in relation to his illegitimate child.

The family is the basic unit in our society. When there is a breakdown in this unit, specifically in the marital relationship, the effect upon the husband, wife, and children can be devastating in terms of poverty, abuse, and cost to society. The frequent inability of the poor to obtain counseling and legal assistance in resolving family relationships perpetuates the social and psychological results of a poor marriage. It is increasingly common to find families composed of husband, wife and young children, where both husband and wife are gainfully employed. For some, this pattern is regarded as preferable to the older "ideal" family, where the husband was the sole breadwinner and the wife cared for the children, performed household chores and perhaps engaged in social or charitable activities. Where both spouses are gainfully employed, it is often necessary for the family to employ household help to care for the children and do the housework. The Balance Between Individual Rights And Family Preservation: The Future Of The Parent-Child Immunity Doctrine In Texas., Robert L. Galligan

St. Mary's Law Journal

In the last decade approaching the 1970s, Texas has adopted a less rigid approach to the parent-child immunity doctrine, which equips parents with immunity from suits involving tort actions brought by their children. The support for this doctrine relies on the rationale that such actions disrupt family harmony and parental discipline averse to a civil society. This study examines the origin, development, and subsequent erosion of the parent-child immunity doctrine in other state jurisdictions by analyzing its development in common law. Texas’s approach to the parent-child immunity doctrine mirrors the developments of other state jurisdictions. While some states eliminated the …

From those who regard marriage as a perpetual and indissoluble bond instituted by God to those who consider it a terminable contract between a man and a woman, every shade of opinion can be found. At common law neither spouse could maintain an action against the other. With the passage of the Married Woman's Acts in the mid-nineteenth century it was agreed that a cause of action would then lie for property torts, but there was confusion as to whether the statutes gave a new cause of action for personal torts between the spouses. It therefore became a question of statutory interpretation, with the terminology of most of the statutes being consistent with either conclusion. Adoption has been defined as "The act by which the relations of paternity and affiliation are recognized as legally existing between persons not so related."' When a family starts to dissolve it frequently comes to the attention of the court or the welfare department and what happens once its members enter the system can be of critical importance. While the number of adults incarcerated is expected to increase slightly, the alarming fact is that if we continue to confine juveniles at the same rate an increase of 70% between 1965 and 1975 can be expected. These data suggest that we should investigate alternatives to detention, not only because of the increasing pressures of space available but, more importantly, because juvenile detention has shown itself to …
