A Child's Right To A Name: An Emphasis On The Iranian Legal System, Abbas Mirshekari, Alireza Fattahi Ketilate

Children's Legal Rights Journal

This article provides an interpretation of the Iranian legal system in which individuals are free to choose their own name, unless the choice of a particular name is prohibited by law, depending on a concrete and reasonable justification. Accordingly, both the right of children to have a name and the right of parents to freely choose a name for their children will be explored. A parent's right to name can also be framed as an example of parental rights to their children; albeit a parent's right to name is constitutionally restricted by a principle prohibiting abuse of the right. Illinois Childcare Parentage Law (R)Evolution, Jeffrey A. Parness Jan 2020

Illinois Childcare Parentage Law (R)Evolution, Jeffrey A. Parness

Loyola University Chicago Law Journal

State childcare parentage laws, that is, laws designating parents for custody, visitation, parental responsibility allocation, parental decisionmaking and/or support purposes, have evolved dramatically in the past half century. The (r)evolution is due to major changes in both reproductive technologies and human conduct. Yet the (r)evolution is incomplete.

The (r)evolution is especially incomplete in Illinois. Recent statutory amendments in Illinois chiefly reflect the work of the National Conference of Commissioners on Uniform State Laws in its 2000 model Uniform Parentage Act, not its 2017 Uniform Parentage Act. The latter better addresses the effects on childcare parentage of the changes in …

Guarding The Guardians: Should Guardians Ad Litem Be Immune From Liability For Negligence?, Alberto Bernabe Jan 2020

Guarding The Guardians: Should Guardians Ad Litem Be Immune From Liability For Negligence?, Alberto Bernabe

Loyola University Chicago Law Journal

Illinois has a very comprehensive regulatory system for guardianships, which are recognized and regulated by several different statutes including the Illinois Probate Act and the Illinois Marriage and Dissolution of Marriage Act. Unfortunately, notwithstanding this comprehensive regulation, courts have struggled with the question of whether guardians ad litem should be immune from possible liability for injuries caused to their wards. Under the Marriage Act, an attorney appointed as a guardian ad litem is expected to perform duties on behalf of the court while the language of the Probate Act suggests that a guardian ad litem is appointed to represent the …

The Promise And Failures Of Children's Medicaid And The Role Of Medical-Legal Partnerships As Monitors And Advocates, Kate Mitchell Jan 2020

The Promise And Failures Of Children's Medicaid And The Role Of Medical-Legal Partnerships As Monitors And Advocates, Kate Mitchell

Faculty Publications & Other Works

For decades we have known that access to health care and early and preventive diagnosis and treatment can dramatically alter the course of a child’s life. Because of this knowledge, immediately after Congress enacted Medicaid, it created the Early and Periodic Screening, Diagnostic and Treatment, or EPSDT, program for children. EPSDT requires broad holistic and preventive care to correct or ameliorate health defects identified in Medicaid-eligible children. This coverage currently extends to 2 out of 5 children and 48 percent of children with special health care needs. Because of the broad parameters of coverage mandated by EPSDT, eligible children should …

Improving Protection And Services For Trafficking Victims In The United States: Recommendations Based On The United Kingdom's Modern Slavery Act 2015, Yusuf Abdulkareem

Children's Legal Rights Journal

Human trafficking is a form of modern slavery that occurs both internationally and within national borders. It is a multibillion-dollar criminal industry, and millions of men, women, and children have been victims of this heinous and unconscionable crime.2 Fortunately, the problem of human trafficking has finally started to receive the attention it deserves. Over the past two decades, a plethora of anti-trafficking laws have been passed at both international and domestic levels. The United States specifically has been a leader in the promulgation of anti-trafficking laws that have served as models for other nations of the world. These federal laws, …
